PART I <br /> Permit No.: COR400000 <br /> (15) Operator - The party that has operational control over day-to-day activities at a project site which <br /> are necessary to ensure compliance with the permit. This party is authorized to direct individuals <br /> at a site to carry out activities required by the permit.(e.g. the general contractor) <br /> (16) Owner-The party that has overall control of the activities and that has funded the implementation <br /> of the construction plans and specifications. This is the party with ownership of, a long term lease <br /> of, or easements on the property on which the construction activity is occurring (e.g., the <br /> developer). <br /> (17) Permittee(s) - The owner and operator named in the discharge certification issued under this <br /> permit for the construction site specified in the certification. <br /> (18) Point Source - Any discernible, confined, and discrete conveyance, including, but not limited to, <br /> any pipe, ditch, channel, tunnel, conduit, well, discrete fissure, container, rolling stock, <br /> concentrated animal feeding operation, or vessel or other floating craft, from which pollutants are <br /> or may be discharged. Point source does not include irrigation return flow. See 5 CCR 102-61.2(75). <br /> (19) Pollutant - Dredged spoil, dirt, slurry, solid waste, incinerator residue, sewage, sewage sludge, <br /> garbage, trash, chemical waste, biological nutrient, biological material, radioactive material, heat, <br /> wrecked or discarded equipment, rock, sand, or any industrial, municipal or agricultural waste. See <br /> 5 CCR 1002-61.2(76). <br /> (20) Presentation of credentials - a government issued form of identification, if in person; or (ii) <br /> providing name, position and purpose of inspection if request to enter is made via telephone, email <br /> or other form of electronic communication. A Permittee's non-response to a request to enter upon <br /> presentation of credentials constitutes a denial to such request, and may result in violation of the <br /> Permit. <br /> (21) Process Water - Any water which, during manufacturing or processing, comes into contact with or <br /> results from the production of any raw material, intermediate product, finished product, by <br /> product or waste product. <br /> (22) Public Emergency Related Site - a project initiated in response to an unanticipated emergency <br /> (e.g., mud slides, earthquake, extreme flooding conditions, disruption in essential public services), <br /> for which the related work requires immediate authorization to avoid imminent endangerment to <br /> human health or the environment, or to reestablish essential public services. <br /> (23) Qualified Stormwater Manager-An individual knowledgeable in the principles and practices of <br /> erosion and sediment control and pollution prevention, and with the skills to assess conditions at <br /> construction sites that could impact stormwater quality and to assess the effectiveness of <br /> stormwater controls implemented to meet the requirements of this permit. <br /> (24) Qualifying Local Program - A municipal program for stormwater discharges associated with small <br /> construction activity that was formally approved by the division as a qualifying local program. <br /> (25) Receiving Water -Any classified or unclassified surface water segment (including tributaries) in the <br /> State of Colorado into which stormwater associated with construction activities discharges. This <br /> definition includes all water courses, even if they are usually dry, such as borrow ditches, arroyos, <br /> and other unnamed waterways. <br /> (26) Severe Property Damage - substantial physical damage to property, damage to the treatment <br /> facilities which causes them to become inoperable, or substantial and permanent loss of natural <br /> resources which can reasonably be expected to occur in the absence of a bypass. Severe property <br /> damage does not mean economic loss caused by delays in production. See 40 CFR 122.41(m)(1)(ii). <br /> Page 19 of 33 <br />
