As you may also know <br /> under federal law, our office takes on a formal consulting role on projects that have the potential to affect historic properties <br /> (such as buildings and archaeological sites). If this project includes Federal involvement (funding, permits and/or land), Section <br /> 106 of the National I listoric Preservation Act (16 U.S.C. 470) requires federal agencies to meet the requirements of as set forth <br /> in 36 CFR 800 ("Protection of Historic Properties") and the lead federal agency is legally responsible for all required findings <br /> and determinations of National Register of Historic Places (NRHP) eligibility and project effects (36 CFR 8002(a) (3)). Also <br /> should human remains be discovered during project activities, the requirements under C.R.S. 24-80 (part 13) apply and must be <br /> followed. <br /> Thank you for the opportunity to comment.
