As you may also know under federal law, our office takes on a formal consulting role on projects that have the potential to affect historic properties (such as buildings and archaeological sites). If this project includes Federal involvement (funding, permits and/or land), Section 106 of the National I listoric Preservation Act (16 U.S.C. 470) requires federal agencies to meet the requirements of as set forth in 36 CFR 800 ("Protection of Historic Properties") and the lead federal agency is legally responsible for all required findings and determinations of National Register of Historic Places (NRHP) eligibility and project effects (36 CFR 8002(a) (3)). Also should human remains be discovered during project activities, the requirements under C.R.S. 24-80 (part 13) apply and must be followed. Thank you for the opportunity to comment.
