3. Highwall Conformance to Current Mining Plan <br /> The currently approved mining plan, specifically Stipulation#1, states that the quarrying must be <br /> benched at 12 feet wide and 35 feet tall. The current highwall is a single bench in several <br /> locations, reaching a height of 100 feet. Within the current permit area,the site highwall has a <br /> bench width of over 100 feet in most locations. In effect, Elk Creek Sand and Gravel has <br /> maintained the necessary overall slope for stability but has not benched the slope in the manner <br /> stated in the CDRMS approved permit. <br /> 4. Achieving Mining Plan Conformance <br /> The benching configuration in the currently approved permit can be modified as part of a <br /> technical revision. This would bring it in line with the highwall that is currently found onsite. <br /> Alternatively,the operator could remove the necessary material from the highwall to create the <br /> benches in the configuration in the approved permit. <br /> 5. Assumptions and Limitations <br /> The analysis in this report is based on a review of available existing surveys and reports provided <br /> by the operator to Mr. Misantoni and Lewicki and Associates staff, along with a site visit on <br /> April 29, 2019. All conclusions and recommendations in this report are dependent on this <br /> information. No additional mapping of geological structures has been conducted. Changes to <br /> conditions observed in this report would necessitate its revision or replacement by a new <br /> comprehensive geologic analysis. Geotechnical evaluations made are based on the Brierley <br /> report from 2004 and do not evaluate any conditions that fall outside the analysis of that report. <br /> Topographic conditions are based on the data available from the Falcon Surveying, Inc. survey <br /> from 2018. <br /> 6. Attachments <br /> Table 2 contains a list of attachments of relevance to this document.
