6. Waiver of Lateral Support. Lessor hereby waives 'at:ral support as <br /> reasonably necessary for mining purposes for the po ions of the Property <br /> abutting boundary lines between the Property and adj:cent properties that are <br /> or hereafter be owned or leased by the Company. Co pany shall replace or <br /> restore any improvements such as fences damaged b removal of lateral <br /> support. <br /> 7. Ingress and Egress. The Company shall have the rig t of ingress and egress to <br /> and from the said property. <br /> 8. Liabilities. <br /> a. Company shall defend and indemnify and hole harmless the Lessor <br /> and Lessor's agents and employees from and .gainst any and all <br /> claims, demands,judgments and liability, inc uding reasonable <br /> attorney fees and expert fees,by or to any an' all third parties that may <br /> arise as a result of the negligent acts or omiss ons of Company or its <br /> agents, representatives, officers, employees, 1-ssees and contractors, in <br /> or about the Property. <br /> b. The Company shall defend, indemnify, and held harmless Lessor from <br /> any and all liability resulting from the Comp.ny operations hereunder <br /> pursuant to all local, state and federal enviro mental laws, ordinances, <br /> rules and regulations. including but not limit;d to,the Comprehensive <br /> Environmental Response, Compensation and Liability Act of 1980 (42 <br /> U.S.C. § 9601 et seq.)and the Resource Con•ervation and Recovery <br /> Act(42 U.S.C. § 6901 et seq.), as any of suc laws, ordinances,rules <br /> and regulations have been or are amended fr m time to time. <br /> c. The foregoing indemnifications shall all survi ve the termination of this <br /> Lease. The indemnity provisions set forth in this Lease shall apply to <br /> amounts paid in settlement of a claim by an i demnified party only if <br /> such settlement is approved by the indemnif ing party, which approval <br /> shall not be unreasonably withheld and shall include any and all legal <br /> fees, costs and expert witness fees incurred 9 the party being <br /> indemnified. <br /> 9. Insurance. <br /> a. The Company shall maintain at its sole expe se and at all times <br /> statutory Workers Compensation Insurance overage as required under <br /> the laws and regulations of the State of Colo ado for all its officers and <br /> employees who perform work for the Comp ny hereunder. <br /> b.
