Mr. Andy Rodriguez, P.E. <br />Beltway's Brighton Combined SWSP <br />April 24, 2019 <br />Page 3 of 6 <br />According to Table 3 all lagged depletions will be replaced from fully consumable effluent <br />leased from the City of Aurora, and pumping of the existing Laramie -Fox Hills aquifer well. <br />The applicant has entered into a long term lease agreement with the City of Aurora <br />("Aurora") whereby Aurora will deliver up to 49 acre-feet of fully consumable water to the <br />South Platte River at the confluence of the South Platte River F± Sand Creek, just north of <br />Metro Wastewater Treatment Plant. The confluence is located approximately 20 miles <br />upstream of the Baseline Resource site. A 0.25 percent per mile transit loss for November <br />through March (5.0 percent overall loss) and a 0.5 percent per mile transit loss for April <br />through October (10.0 percent overall loss) has been accounted for in the replacement <br />schedule. The transit loss is subject to change depending upon current conditions. If transit <br />losses will change they will be communicated by the Division Engineer via email to the <br />Division One Call List. <br />In addition to replacing lagged depletions resulting from previous mining operation, the City <br />of Aurora effluent will also be used by the Applicant to replace 28.32 acre-feet of depletions <br />resulting from operation of the Bestway Concrete Well No. 1 (aka the Litvak Well, permit no. <br />67418-F, WDID 0210164), in accordance with the Bestway Concrete Augmentation plan (water <br />court case no. 2004CW224). Since the City of Aurora effluent is being used as a replacement <br />source for this SWSP and the Litvak Well (case no. 2004CW224), the applicant's accounting for <br />this SWSP and case no. 2004CW224 must specify the total amount of effluent released and the <br />amount associated with this SWSP and the court case. <br />A monthly breakdown of depletions and replacements, including the Litvak obligations, is <br />shown on the attached Table 3. <br />Conditions of Approval <br />This SWSP is hereby approved pursuant to Section 37-90-137(11), C.R.S., subject to the <br />following conditions: <br />1. This SWSP shall be valid for the period of January 1, 2019 through December 31, 2021, <br />unless otherwise revoked, modified, or superceded by decree. <br />2. There shall be no groundwater exposed, and no uses of groundwater, at the Brighton <br />Pit site or Parker-Dersham Pit site unless an amendment to this SWSP is approved. <br />3. All diversions shall be measured in a manner acceptable to the division engineer. The <br />Applicant shall install and maintain such measuring devices as required by the division <br />engineer for operation of this SWSP. <br />4. Conveyance loss for delivery of augmentation water is subject to assessment and <br />modification as determined by the division engineer. Currently a 0.25 percent per <br />mile transit loss for November through March (5.0 percent overall loss) and a 0.5 <br />percent per mile transit loss for April through October (10.0 percent overall loss) per <br />mile conveyance loss is being assessed, subject to change depending upon current <br />conditions. <br />5. The Division Engineer, or his designated representative, will administer all such water <br />transported in the South Platte River or its tributaries under this SWSP, including <br />water for replacement of depletions, past intervening headgate to ensure that such <br />water is not intercepted or otherwise diminished in quantity by diversion, use or other <br />
