Mr. Martin:
On April 26, 2019 the Division of Reclamation, Mining and Safety approved the Amendment application
submitted to the Division on January 18, 2019, addressing the following:
Add 67.2ac to permit, and address slope stability issues.
The terms of the Amendment AM04 approved by the Division are hereby incorporated into Permit M1974-
086. All other conditions and requirements of Permit M 1974-086 remain in full force and effect. In addition,
the following condition will be an enforceable part of the permit until it is satisfied through DRMS approval
of the required Technical Revision:
Within 90 days of the AM04 approval date at the top of this letter the permittee shall submit to DRMS as a
technical revision to the permit:
1) A demonstration with data and rationale, or an approvable plan to provide such documentation, that
the mining plan as proposed in AM04 will not intercept groundwater in excess of the SEO lined
reservoir criteria;
OR
2) List of actions that will be taken by the permittee to maintain compliance with applicable regulations
if groundwater is exposed in excess of the SEO lined criteria in the course of mining as currently
approved, including adjustments to the financial warranty that would be required.
The revised liability amount exceeds the performance bond currently held (see below), please submit
additional bond within 60 days of the approval date at the top of this letter. The revision will not be final until
the revised bond is approved by the Division. You will also need to execute the included performance
warranty included with this letter and return the original to the Division.
