COLORADO <br /> Division of Reclamation, <br /> Mining and Safety <br /> De-13rtincnt of fI iuna]R,snurcFs <br /> 1313 Sherman Street, Room 215 <br /> Denver,Colorado 80203 <br /> April 26, 2019 <br /> Mr. Mark Martin <br /> Asphalt Paving Company <br /> 14802 W 44th Ave <br /> Golden, CO 80403 <br /> Re: Ralston Quarry,Permit M-1974-086,Amendment Approval,Revision AM04 <br /> Mr. Martin: <br /> On April 26, 2019 the Division of Reclamation, Mining and Safety approved the Amendment application <br /> submitted to the Division on January 18, 2019, addressing the following: <br /> Add 67.2ac to permit, and address slope stability issues. <br /> The terms of the Amendment AM04 approved by the Division are hereby incorporated into Permit M1974- <br /> 086. All other conditions and requirements of Permit M 1974-086 remain in full force and effect. In addition, <br /> the following condition will be an enforceable part of the permit until it is satisfied through DRMS approval <br /> of the required Technical Revision: <br /> Within 90 days of the AM04 approval date at the top of this letter the permittee shall submit to DRMS as a <br /> technical revision to the permit: <br /> 1) A demonstration with data and rationale, or an approvable plan to provide such documentation, that <br /> the mining plan as proposed in AM04 will not intercept groundwater in excess of the SEO lined <br /> reservoir criteria; <br /> OR <br /> 2) List of actions that will be taken by the permittee to maintain compliance with applicable regulations <br /> if groundwater is exposed in excess of the SEO lined criteria in the course of mining as currently <br /> approved, including adjustments to the financial warranty that would be required. <br /> The revised liability amount exceeds the performance bond currently held (see below), please submit <br /> additional bond within 60 days of the approval date at the top of this letter. The revision will not be final until <br /> the revised bond is approved by the Division.
