The wording within MR-31 implies that these <br />enhancements are a necessary aspect of the mining and reclamation plan to protect the hydrologic <br />balance, and to meet stream standards. If that is the case, the enhancements would be considered mining <br />and reclamation activities. This would restart the liability clock, the acres would need to be bonded, and a <br />technical revision submitted for review. <br /> <br />If it is the intention of the operator is to inform DRMS of activities on Phase III released areas within the <br />permit boundary that are not mining and reclamation related, then the appropriate inclusion into the PAP <br />would be a few sentences describing those activities. <br /> <br />In relation to Pond 002: <br /> <br />The Pond 002 area has not been released of any liability. If the operator deems these enhancement <br />necessary to treat water to protect the hydrologic balance and meet stream standards, the enhancements <br />will become a regulated part of the CDRMS permit, in addition to any associated permits required by <br />other agencies, and the enhancements will be expected to be maintained as a necessary feature. If this is <br />the case, a technical revision will need to be submitted so that a more thorough review of water quality <br />and stream standards can occur. <br />
