Mr. Peter Hays <br /> RE:Lazy Two Pit M-2019-001 <br /> April 17, 2019 <br /> Agreements that have been completed are attached. The agreements that are in progress will <br /> be forwarded to the Division when they are complete. The agreement to be completed with <br /> Weld County Public Works for the county roads and right-of-ways is described in the <br /> minutes from the applicant's Weld County USR for Mining Operation pre-application <br /> meeting. Therefore, agreements have been, or will be, obtained for all significant man-made <br /> structures within two hundred (200) feet of the affected land. <br /> Although a structure agreement has not been obtained from Indian Creek Land and Cattle, <br /> the man-made structures only include an unimproved access road and culvert that are located <br /> on the far side of County Road 21 from the site. With a 25-foot mining setback from the <br /> county road 60-foot right-of-way, the structures are located a minimum of 67 feet from the <br /> mining limits. Mining activities associated with the 10-foot deep pit are not expected to <br /> affect these structures. <br /> A structure agreement has not been obtained from Thomas Ranch for a 3-strand wire fence. <br /> The fence appears to have been placed at or near the Weld County Road 120 right-of-way <br /> and is at least 30 feet from the Lazy Two Pit permit boundary. With the 25-foot mining <br /> setback, the fence is 55 feet from the mining limit. Mining activities associated with the 10- <br /> foot deep pit are not expected to affect these structures. <br /> 21.
