Cblue ear-th <br /> SOLUTIONS <br /> April 17, 2019 <br /> Colorado Department of Natural Resources <br /> Division of Reclamation, Mining and Safety <br /> Attn: Mr. Peter Hays <br /> 1313 Sherman Street; Room 215 <br /> Denver Colorado, 80203 <br /> RE: Response to Adequacy Review Comments for Connell Resources,Inc. <br /> Lazy Two Pit,Permit No. M-2019-001 <br /> Dear Mr. Hays: <br /> The following discussion and attachments are submitted on behalf of our client, Connell <br /> Resources, Inc., in response to the Adequacy Review comments prepared by the Division of <br /> Reclamation, Mining and Safety dated March 12, 2019 for the Lazy Two Pit 112 Construction <br /> Materials Reclamation Permit application. The information and discussion below addresses each <br /> comment as it was presented by the Division: <br /> 1. Proof of publication in a newspaper of general circulation is attached. Publications were <br /> made on January 23 and 30, 2019 and February 6 and 13, 2019 in the Coloradoan newspaper. <br /> 2. Proof of notice to all owners of record of surface and mineral rights of affected land and <br /> surface owners and easement holders within 200 feet of the affected land is attached. Notices <br /> were sent to owners and easement holders after the January 23, 2019 publication. The <br /> certified letter return receipts are attached. <br /> 3. The Colorado Division of Water Resources comments have been reviewed and (1) no <br /> groundwater will be exposed during mining, (2) water trucked to the site will be obtained <br /> from a legal source, and (3) stormwater will not be detained in the mining cell for more than <br /> 72 hours. <br /> The Office of Archaeology and Historic Preservation comments have been reviewed and if <br /> cultural resources are uncovered during mining the proper authorities and/or agencies will be <br /> notified. If human remains are discovered during mining, earth moving activities in the area <br /> will stop and the authorities will be notified. <br /> The Department of the Army comments were reviewed and the Lazy Two Pit property does <br /> not contain Waters of the U.S. nor will any Waters of the U.S. be disturbed during mining <br /> and reclamation activities. The project site is also not within a Federal Emergency <br /> Management Agency jurisdictional floodplain or other floodplain regulated by Weld County. <br /> During the wildlife review and assessment of the site and surrounding lands, U.S. Fish and <br /> Wildlife references were used to evaluate the potential presence and impact on threatened <br /> and/or endangered wildlife species.
