Mr. Miller/North Star Pit <br /> April 11, 2019 <br /> Page 3 of 3 <br /> the affected area,the applicant may either: <br /> a.)Provide a notarized agreement between the applicant and the person(s)having an interest in the structure, <br /> that the applicant is to provide compensation for any damage to the structure; or <br /> b.) Where such an agreement cannot be reached, the applicant shall provide an appropriate engineering <br /> evaluation that demonstrates that such structure shall not be damaged by activities occurring at the mining <br /> operation. <br /> Please provide evidence(certified letter to structure owners)that a notarized agreement between the structure <br /> owners and the applicant was pursued. If an agreement is unable to be reached a geotechnical assessment <br /> may be provided to demonstrate that the structures shall not be damaged. <br /> You must provide information sufficient to demonstrate that the stability of any structures located within <br /> two hundred(200)feet of the operation or affected land will not be adversely affected. <br /> Please provide evidence(such as proof of delivery of certified letter to structure owners)that a notarized <br /> agreement between the structure owners and the applicant was pursued If an agreement is unable to be <br /> reached a geotechnical assessment may be provided to demonstrate that the structures shall not be damaged. <br /> Additional Information:You will also need to provide the Division with proof of notice posting—a template <br /> for this is provided in the 112c application package available at the DRMS website. <br /> Your application will not be considered submitted until the information listed above is received and found sufficient <br /> to begin our review. A decision date will be established 90 days from the date of receipt of all of the requested <br /> information. Additionally, if you have already published notice you will need to republish notice, after the Division <br /> considers the application submitted. This notice must be published once a week for four(4)consecutive weeks, <br /> starting within ten(10)days of the date your application is considered submitted. We will notify you when you <br /> should initiate republication of your notice. The final date for receiving comments is the 20th day after the fourth <br /> publication or the next regular business day. <br /> Because this amendment is required to resolve outstanding corrective actions failure to submit an amendment that is <br /> able to be approved within the statutory timeframe will result in enforcement actions <br /> This letter shall not be construed to mean that there are no other technical deficiencies in your application.
