The following inspection topics were identified as having Problems or Possible Violations. OPERATORS
SHOULD READ THE FOLLOWING PAGES CAREFULLY IN ORDER TO ASSURE COMPLIANCE
WITH THE TERMS OF THE PERMIT AND APPLICABLE RULES AND REGULATIONS. If a
Possible Violation is indicated, you will be notified under separate cover as to when the Mined Land
Reclamation Board will consider possible enforcement action.
INSPECTION TOPIC: Availability Of Records
PROBLEM/POSSIBLE VIOLATION: Problem: The Operator has not submitted Structure agreements for any
significant, valuable, and permanent manmade structures for Highway 6, the Railroad, Century Link, Power
Poles and any other utility within 200 feet of the Affected Land. This is a possible violation at this time pursuant
to: C.R.S. 34-32.5-115(4)(e). In 2014 Old Castle SW Group obtained the permit from LaFarge West with a 180
day stipulation that Structure Agreements must be submitted. The Division approved the SO with a stipulation
that structure agreements would be submitted. Currently, the Division has structure agreements from the Land
Owner for Drainage Structures and a Fence.
CORRECTIVE ACTIONS: Where the mining operation will adversely affect the stability of any
significant, valuable and permanent man-made structure located within two
hundred (200) feet of the affected land, the applicant may either:
(a) provide a notarized agreement between the applicant and the
person(s) having an interest in the structure, that the applicant is to
provide compensation for any damage to the structure; or
(b) where such an agreement cannot be reached, the applicant shall
provide an appropriate engineering evaluation that demonstrates
that such structure shall not be damaged by activities occurring at
