OPERATORS <br />SHOULD READ THE FOLLOWING PAGES CAREFULLY IN ORDER TO ASSURE COMPLIANCE <br />WITH THE TERMS OF THE PERMIT AND APPLICABLE RULES AND REGULATIONS. If a <br />Possible Violation is indicated, you will be notified under separate cover as to when the Mined Land <br />Reclamation Board will consider possible enforcement action. <br />INSPECTION TOPIC: Availability Of Records <br />PROBLEM/POSSIBLE VIOLATION: Problem: The Operator has not submitted Structure agreements for any <br />significant, valuable, and permanent manmade structures for Highway 6, the Railroad, Century Link, Power <br />Poles and any other utility within 200 feet of the Affected Land. This is a possible violation at this time pursuant <br />to: C.R.S. 34-32.5-115(4)(e). In 2014 Old Castle SW Group obtained the permit from LaFarge West with a 180 <br />day stipulation that Structure Agreements must be submitted. The Division approved the SO with a stipulation <br />that structure agreements would be submitted. Currently, the Division has structure agreements from the Land <br />Owner for Drainage Structures and a Fence. <br />CORRECTIVE ACTIONS: Where the mining operation will adversely affect the stability of any <br />significant, valuable and permanent man-made structure located within two <br />hundred (200) feet of the affected land, the applicant may either: <br />(a) provide a notarized agreement between the applicant and the <br />person(s) having an interest in the structure, that the applicant is to <br />provide compensation for any damage to the structure; or <br />(b) where such an agreement cannot be reached, the applicant shall <br />provide an appropriate engineering evaluation that demonstrates <br />that such structure shall not be damaged by activities occurring at <br />Page 1 of 9 <br />
