LEASE AGREEMENT <br /> THIS LEASE AGREEMENT (the "Lease") is made and entered into by and <br /> between CASTLE ROCK CONSTRUCTION COMPANY OF COLORADO <br /> LLC, 6374 S. Racine, Centennial, Colorado, 80111 ("Lessee") and The <br /> City Lamar Water Department, 103 N 2nd St, Lamar CO 81052 (719) 336- <br /> 2002 (Lessor"). <br /> Lessee would buy water from Tank Storage Facility that the Lessor owns and <br /> operates. <br /> NOW, THEREFORE, it is mutually agreed that <br /> 1. Supply of Water for a Construction Operations. For consideration <br /> described in paragraph two, the Lessors will permit Lessee and the Related <br /> Parties (defined below) to enter upon this property for the purposes of <br /> purchasing water for a construction operation. All costs of such Operations <br /> shall be borne solely by Lessee. Upon termination of this Lease for any <br /> reason, Lessee at its sole cost and expense shall cause the Property to be <br /> restored to substantially the condition it was in prior to the Operations. In <br /> addition, Lessee shall be responsible for and shall indemnify Lessor from and <br /> against any claims, demands or other liability related to purchasing water or <br /> Lessee's or the Related Parties' actions or inactions with respect to real <br /> property which is adjacent or nearby the Property (the "Adjacent Property"). <br /> Lessee understands that: <br /> (a) All equipment will be operated by Lessee and the Related <br /> Parties and only in areas on the Property acceptable to the <br /> Lessor. <br /> (b) Lessor is to be contacted to inspect the Property to ensure <br /> that it has been restored to an acceptable condition prior to <br /> removal of Lessee's equipment at the termination of this <br /> Lease. <br /> (c) The Lessee is aware of, and will abide by, the articles of <br /> this Lease Agreement. <br /> (d) All equipment is to be supplied by the Lessee including <br /> but not limited to; pumps, power supply, hose and water <br /> meter. <br /> (e) Lessor does not require a backflow preventer when <br /> pulling out of storage ponds. <br /> 2. Royalty. For supply of the water that has been described herein and <br /> purchase of water, the Lessee agrees to pay the Lessors the sum of <br /> $X.XX per MGAL for a estimated 500,000 MGAL of water. <br /> Payments will be made monthly based on water meter readings from <br /> the well. A dedicated water meter is to be supplied by Lessee and read <br /> jointly prior to pumping operations beginning. The estimated interim <br /> quantities will be paid within 30 days of receiving water. The term of <br /> this Lease shall commence upon the 22°d of April, 2019 and run for 1 <br /> year from that date. <br /> 1 <br />
