("Cotter") dated March 1, 2019, Cotter submits this notice of temporary cessation <br /> ("Notice")requesting a second five-year period of temporary cessation for the JD-8 Mine, <br /> Permit No. M-1984-014. On May 15, 2013,the Mined Land Reclamation Board("Board") <br /> unanimously authorized,through approval of its consent agenda, an initial five-year period of <br /> temporary cessation for the JD-8 Mine, effective March 18, 2013. No comments were <br /> received by the Board opposing that request, as set forth in the Board's Summary of Minutes <br /> for the May 15, 2013 Board meeting. Cotter here requests a second five-year period of <br /> temporary cessation for the JD-8 Mine, commencing at the end of the JD-8 Mine's initial <br /> period of temporary cessation, and a hearing on such request. It also respectfully submits <br /> that the Board should continue the hearing and toll the running of the JD-8 Mine's second <br /> five-year period of temporary cessation, as specified in sections IV and V of this Notice. <br /> Under Hard Rock/Metal Mining Rule 1.13.5(3), operators must include the following <br /> information in notices requesting a second five-year period of temporary cessation: <br /> (1) explanation as to why the operator has not recommenced operations or begun <br /> reclamation; (2) demonstration that the existing financial warranty is adequate to cover the <br /> reclamation liability; and(3)demonstration of the operator's continued commitment to <br /> mining operations at the site by the end of the second five-year period of temporary <br /> cessation. This information is set forth below for the JD-8 Mine. Because this Notice <br /> contains the information required by Hard Rock/Metal Mining Rule 1.13.5(3), and the JD-8 <br /> Mine complies with the Colorado Mined Land Reclamation Act("MLRA"), §§ 34-32-101 to <br /> -127, and any additional applicable statutes, regulations, and rules,this Board should grant <br /> Cotter a second five-year period of temporary cessation for the JD-8 Mine.
