The resulting product will be available for purchase for construction <br /> and road base. <br /> WHEREAS,the Planning and Zoning Commission held a Public Meeting on <br /> January 24, 2019 and were informed that the raw material is already occupying an area <br /> approximately 1.8 acres on the west end of the Bootjack Ranch property near the river <br /> and was obtained through activity sanctioned by the Army Corps of Engineers. They <br /> were further informed that there will be no excavation or mining activity at the sight and <br /> that this will not go into extended perpetuity. There were no objections from the public. <br /> Based upon the above, and after careful consideration,the Planning and Zoning <br /> Commission made the recommendation to the Board of County Commissioners that the <br /> conditional uses be granted as presented without additional conditions; and <br /> WHEREAS, the Board of County Commissioners held a Public Hearing on <br /> February 19, 2019 in accordance with the Mineral County Zoning Regulations, and has <br /> adopted this Resolution pursuant to Article 3, Section 3.2 E of such regulations. <br /> Accordingly: <br /> Finding of Fact <br /> The Board makes the following finding of fact with respect to the proposed uses: <br /> The Board has reviewed all relevant testimony and materials available to the <br /> Board. <br /> The project is located on Boot Jack Ranch in Mineral County at the address of: <br /> 12500 U.S. Highway 160, Pagosa Springs, CO. The location of the raw material <br /> is on the west end of the Bootjack Ranch property near the river. The property is <br /> zoned Rural. All property owners adjacent to Bootjack Ranch including the San <br /> Juan National Forest were notified. <br /> The process appears to comply with all applicable state and federal law. <br /> All procedural requirements of the County Regulations for the adoption of this <br /> resolution have been met. <br /> 15 <br /> 03/28/2019 <br />
