2. Batch Plant Operations. For Consideration described in paragraph two, <br /> the Lessors will permit Lessee and the related Patties (defined below)to enter upon <br /> this property for the purpose of operating a concrete batch plant thereon. together <br /> with the transporting materials toad n from the property in connection with the said <br /> operations. All cost of such Operations shall be borne solely by lessee. Upon <br /> termination of this Lease for any reason, lessee at its sole cost and expense shall <br /> cause the Property to be restored to substantially the condition it was in prior to the <br /> Operations. In addition, Lessee shall be responsible for and shall indemnify Lessor <br /> from and against any claims, demands or other liability related to the batch <br /> Operations or Lessee's or the Related Parties' actions or inactions with respect to the <br /> real property which is adjacent or nearby the Property (the"Adjacent Property"). <br /> This includes without limitation damage to the Batch Plant Operations. <br /> 3. Royalty. For use of the land as described herein and purchase <br /> of the dirt borrow material,the Lessee agrees to pay the Lessors the <br /> sum ofGMper cubic yard of material removed. A�deposit is <br /> to be paid in advance of operations commencing and then payments <br /> will be made monthly based on the material removed from the site. <br /> The estimated interim quantities will be paid within 30 days of <br /> removal of the material. Final quantities of borrow material removed <br /> from the property will be determined by a topographical survey both <br /> prior to disturbance of the property and after reclamation of the <br /> property. Final payment will be based on quantities calculated from the <br /> difference in the elevations represented by these two surveys. All <br /> survey information and calculations will be made available to the <br /> Lessors upon completion. The survey costs will be borne by the <br /> Lessee. The term of this Lease shall commence upon the 1 st of April, <br /> 2019 and run for one year from that date. <br /> Compensation for use of the land for the Batch Plant Land as <br /> described herein the Lessee agrees to the Lessors the sum of- <br /> per Acre for an estimated 5 acres. The term of this Lease shall <br /> commence on the 1"of June 2019 and run for 4 months from that date <br /> or until the completion of the project. A 4IMeposit is to be paid <br /> in advance of operations commencing and then payments will be <br /> made monthly based on the material removed from the site. <br /> 4. Access. The Lessee will gain access to the Lessor property by an existing <br /> entrance off of US 287 then by an access road into the property which the Lessee <br /> will have disturb but must regrade upon completion. <br /> 5. Work. It is understood and agreed that all work will be done upon the <br /> Property without expense to the Lessors. All work performed by the Lessee, its <br /> independent contractors, employees, agents or others in any way related to the <br /> Property or this Lease (collectively, the "Related Parties") shall be performed in a <br /> good and workmanlike manner and otherwise pursuant to the terms hereof. <br /> 2 <br />
