It is important to narrow down the issue(s). <br /> My name is Kayle Higinbotham I live <br /> 5975 Wellington Road Chipita Park, CO 80809 <br /> 719 492 5178 cell <br /> Ionersunite3@gmail.com <br /> My property Parcel numbers are: 83150200064 and KAHLM LLC 8300000123 <br /> They are located adjacent to the Houchin Gravel Pit <br /> 831530065, 10840 Hwy 24, Chipita Park, CO 80809 <br /> Nina Ruiz and I have been communicating by email this week in regard to Houchin Gravel Pit(Nina Ruiz is <br /> familiar with the Houchin Mine/Gravel Pit/Higinbotham properties as she was in attendance at a meeting with <br /> Houchin, Higinbotham, Craig Dorsey, Sallie Clark..and others,on 2/1/2017.(I am attaching the minutes of that <br /> meeting,)We discussed the Mining operation permit at that time and ...As I understand it the general <br /> determination was that:the reclamation permit would have to be amended if quarry is expanded . Moving <br /> materials to the other property could be problematic and viewed as an extension of the permit. Special Use <br /> Permit would be required to expand the quarry on a hearing based process. <br /> **In the past month ,truck loads... upon truck loads,(an estimated 60,000+tons of dirt and materials)have <br /> been deposited onto the Parcel site of the Houchin Gravel Pit. <br /> This Dirt is not mined "on-sight"and has been"brought in"from outside sources <br /> Since 2013 and the Waldo Canyon Fire/Floods and until the present time , <br /> the mining operation has expanded greatly with heavy equipment,stockpiling,and selling of dirt/materials <br /> from outside sources. <br /> When I described our concerns to, Nina Ruiz, earlier this week, her comment was: <br /> "What you are describing may be considered an expansion,which is not permitted unless he goes through <br /> the proper process.We would have to complete a visit in order to confirm the violation." <br /> I have also spoken with Tim Cazer with the State Reclamation Department and will be filing a complaint with <br /> that Department as well. He mentioned that the circumstances,as I described, may result in the need for an <br /> amendment of the Reclamation Permit, however before an inspection could be made,a complaint would need <br /> to be filed <br /> The expansion of the Houchin Gravel Pit has resulted in hardship to the surrounding neighbors, in many <br /> ways: <br /> 1.This portion of the Ute Pass Corridor is very windy(especially this past year)Dirt and Debris stockpiled in <br /> huge mounds on the Houchin parcel , blows into the surrounding properties and onto HWY 24 West directly <br /> adjacent to the Gravel Pit. <br /> 2.The constant"noise pollution" , beep, beep , beep(sometimes from morning to night)can be heard by <br /> neighbors,for miles around <br /> 3.The truck after truck, and heavy equipment(parking , loading ,unloading ), creates traffic congestion that <br /> impedes access and visibility,especially for the residents on Wellington Road <br /> 4.We believe that some of Houchin's materials are being stored outside of his parcel, property line and onto <br /> Hwy Frontage.This Impairs visibility and access into my/our property. <br /> Have you contacted the operator or party conducting the operation?If yes, please provide details. <br /> r Yes r No <br /> If known, please provide the name of the operator or party conducting the operation. <br /> Curt Houchin <br /> If known, please provide the Permit or NOI Number(ie M1970111 or P1970111). <br /> Must be entered in the following format: M1970111 or P1970111 (No dashes allowed) <br /> Have you contacted any other agencies or local governments related to this issue or issues?If so, <br /> please provide details. <br /> r Yes r No <br /> Details <br /> I have talked with Nina Ruiz at El Paso County Building Department,who is familiar with the properties in <br /> question , and recommended that I file a complaint which I will do this week I have also spoken with Tim Cazier <br /> who is familiar with the mining operation <br />
