Stover & Associates, Inc <br />2532 North 71h Street, Unit B <br />Grand Junction, CO 81501 <br />Re: Extension of Three -Year Commencement Period, The Fruita Loadout <br />CAM -Colorado, LLC, DRMS Permit No. C-20.0-088 <br />Dear Mr. Stover: <br />On February 6, 2019, the Division received a letter requesting an extension of the three-year period within <br />which surface coal mining and reclamation operations should commence to avoid termination of DRMS <br />Permit No. C-2010-088 for the Fruita Loadout. State law pertaining to this three-year commencement <br />period is found at 34-33-109(6). The associated regulation is found at Section 2.01.5 of the Regulations of <br />the Colorado Mined Land Reclamation Board for Coal Mining ("Regulations"). <br />The first permit issued by DBMS for the Fruita Loadout was for a permit term from March 6, 2012 — March <br />6, 2017. Therefore, the first three-year commencement period was from March 6, 2012 — March 6, 2015. <br />The second three-year commencement period was from March 6, 2015 — March 6, 2018. The third three- <br />year commencement period is from March 6, 2018 — March 6, 2021. <br />Section 2.01.5(2)(e) of the Regulations states "Extensions of time granted by the Division or Board under <br />2.01.5(2)(b) shall be specifically set forth in the permit and notice of the extension shall be made to the <br />public". Please therefore submit an application for a Minor Revision to the Fruita Loadout DRMS permit that <br />provides a revised permit page that documents these three-year commencement periods. <br />The date of the approval of the Minor revision application will be considered the date of the approval of the <br />request submitted to the Division on February 6, 2019. Previous approvals by the Division of previous <br />requests for extensions of the three-year commencement period did not request that the Fruita Loadout <br />permit be revised to specify the start -date and end -date of those commencement periods; for that we <br />apologize. We will consider the approval of the forthcoming Minor Revision application to retroactively <br />approve the start -dates and end -dates of those previous commencement periods.
