insurance shall cover Lessee's operations on the Property and shall name <br /> Lessor as an additional insured. <br /> 8.2 All insurance under this Section 8 shall be issued by insurers duly authorized to <br /> do business in the State of Colorado and each policy shall provide that it may not <br /> be canceled without a minimum of fourteen (14) days prior written notice to <br /> Lessor and Lessee. To the extent reasonably attainable, each policy required <br /> under this subsection 8.2 shall contain a waiver of subrogation clause and <br /> agreement by the insurer that coverage shall not be canceled because of <br /> operations properly conducted under this Lease. <br /> 9. Reclamation and Surrender of Possession. <br /> 9.1 Subject to subsection 1.4 and this Section 9, Lessee shall surrender the Property to <br /> Lessor at the expiration of the Term or upon earlier termination of this Lease. <br /> 9.2 After expiration of the Term or earlier termination of this Lease, Lessee shall <br /> complete at Lessee's expense all reclamation and re-vegetation of the Property (to <br /> the extent such reclamation has not previously been completed) required by any <br /> governmental authority having jurisdiction arising from or based upon Lessee's <br /> operations and activities on the Property under this Lease as and when required by <br /> that governmental authority and in accordance with the terms of the Permits and <br /> all requirements of any governmental authority permitting, authorizing, or having <br /> authority over the Business. Lessee shall have the right of access to the Property <br /> as required to perform the reclamation and re-vegetation work. <br /> 9.3 Notwithstanding Lessee's reclamation requirements set forth in subsection 9.2, if <br /> Lessee has not exercised its option under subsection 3.2 to develop, mine, <br /> produce, remove, process, stockpile and market Common Materials from Pit 5, <br /> Lessee shall not be obligated in any way to reclaim Pit 5 (except for any <br /> disturbances caused by Lessee's exploration activities as provided in subsection <br /> 3.2) and Lessee shall be removed from all bonding obligations for Pit 5. <br /> 9.4 Within 90 days after termination of this Lease by expiration of the Term or <br /> otherwise, Lessee shall remove all equipment, machinery, tools, supplies, and <br /> other personal property, buildings, facilities and installations placed on the <br /> Property by Lessee, except as necessary for completion of reclamation work <br /> required by this Lease. Any such property not removed within that period may be <br /> removed by Lessor at Lessee's expense. <br /> 9.5 Upon completion of reclamation and at Lessor's request, Lessee shall execute and <br /> deliver to Lessor a recordable written release to Lessor of all of Lessee's right, <br /> title, and interest in the Property under this Lease (including, if applicable) any <br /> remaining extensions or renewals of this Lease. <br /> 10.
