NAD83) <br /> Easting: 301373.0 Northing: 4122977.0 <br /> PERMIT TO EXPOSE WATER IN A EXISTING PIT <br /> ISSUANCE OF THIS PERMIT DOES NOT CONFER A WATER RIGHT <br /> CONDITIONS OF APPROVAL <br /> 1) This well shall be used in such a way as to cause no material injury to existing water rights. The issuance of this permit does not <br /> ensure that no injury will occur to another vested water right or preclude another owner of a vested water right from seeking <br /> relief in a civil court action. <br /> 2) The construction of this well shall be in compliance with the Water Well Construction Rules 2 CCR 402-2, unless approval of a <br /> variance has been granted by the State Board of Examiners of Water Well Construction and Pump Installation Contractors in <br /> accordance with Rule 18. <br /> 3) Approved pursuant to CRS 37-90-137(2) and (11), on the condition that this well (gravel pit pond)is operated in accordance <br /> with the Alan and Barbara Sackman Augmentation Plan approved by the Division 7 Water Court in case no. 04CW0064. If this <br /> well (grave[ pit pond)is not operated in accordance with the terms of said decree, it will be subject to administration including <br /> orders to cease diverting water. This well (gravel pit pond) is known as Alan's Lake/Well in 04CW0064, also known as the Keyah <br /> Grande/Alan's Lake. Division of Reclamation, Mining it Safety Permit Number M-2011-026. <br /> 4) The use of ground water for this well (gravel pit pond) is limited to commercial, including the mining of gravel, with post mining <br /> uses including evaporation, piscatorial, stock water and recreation. No other use of water is allowed unless a permit therefor is <br /> approved. <br /> 5) The maximum pumping rate of this well (gravel pit pond) shall not exceed 0.11 cfs (50 gpm). <br /> 6) The annual amount of ground water to be appropriated during mining shall not exceed 10.877 acre-feet, with post mining not to <br /> exceed 11.6 acre-feet, per decree. The total surface area of the gravel pit pond is limited to 6.0 acres. <br /> 7) The owner shall mark the well (gravel pit pond)in a conspicuous place with well permit number(s)and court case number(s) as <br /> appropriate. The owner shall take necessary means and precautions to preserve these markings. <br /> 8) A totalizing flow meter must be installed so as to measure any pumping from this gravel pit pond and maintained in good <br /> working order. <br /> 9) Pursuant to Policy 2014-1 of the State Board of Examiners of Water Well Construction and Pump Installation Contractors <br /> (Board), the minimum construction standards in Rule 10 of the Water Well Construction Rules shall be waived for gravel pit <br /> ponds, except, compliance with Rule 10.1 and its subsections 10.1.2, 10.1.4, 10.1.6 and Rule 10.2 and its subsection 10.2.1 is <br /> required.The owner of the gravel pit pond shall take necessary means and precautions to prevent contaminants from entering <br /> the gravel pit pond. <br /> 10) The boundaries of the gravel pit pond shall be more than 600 feet from any existing well, completed in the same aquifer, that is <br /> not owned by the applicant, and not more than 200 feet from the location specified in 04CW0064. <br /> NOTE: The well structure I.D.#is 7803818. <br /> 5 _ Date Issued: 10/11/2017 <br /> Issued By JOHN GABERT Expiration Date: N/A <br /> Printed 01-07-2019 For questions about this permit call 303.866.3581 or go to www.water.state.co.us Page 1 of 1 <br />
