potential for erosion is minimal. A small office trailer and weigh station that are on the <br /> southern edge of the stockpiled area will be removed without additional earthwork <br /> (Figure 1). The stockpile area and weigh station area are also designated as cottonwood <br /> restoration/enhancement in the U.S. Army Corps of Engineers (USACE) 404 permit and <br /> seeding will be implemented through the USACE permit. All other areas of future <br /> disturbance are associated with wetland mitigation, which is part of the USACE 404 <br /> Permit and no additional disturbances will occur as a result of mining activities. <br /> • Weed spraying has been and will continue to be performed on a regular basis by the <br /> Keyah Grande ranch staff. <br /> • Remaining reclamation involving wetland mitigation is covered under USACE permit <br /> NO. SPK-2006-75335-DC. Ongoing stormwater management and weed maintenance is <br /> also required under this permit. A financial assurance of$380,570.00 has been issued in <br /> relation to past impacts and future wetland mitigations that will ensure that this portion of <br /> reclamation will be completed. <br /> • Only minor stockpiles remain on site. All remaining stockpiles will be used for <br /> improvements on the Keyah Grande Ranch and will not leave the property. <br /> Inspection Topic:: <br /> Hydrologic Balance, Water Quality, compliance with C.R.S. 34-32.5-116(4)©, (d), (e) and(h) as <br /> well as Rules 3.1.5(5), (10) and(11). 3.1.6(1)(b), and 3.1.13 <br /> Problem 2: <br /> Several containers, ranging from full to empty and ranging in capacity from 55 gallon drums to 5 <br /> gallon buckets were present and assumed to contain hydraulic oil, motor oil and other potentially <br /> hazardous materials. The operation is located within an alluvial valley with groundwater <br /> elevations near the surface. The containers were stored in a haphazard manner not protective of <br /> hydrologic resources. <br /> Corrective Actions: <br /> All fuels, oils, lubricants and other hazardous materias stored on site shall have appropriate <br /> secondary containment. Please supply photo documentation that any fuel or hazardous materials <br /> containers are stored properly- including applicablesecondary containment structures by the <br /> corrective action date. Note that secondary containment structures shall consist of an <br /> impermeable containment which could contain all contents of the tanks and various containers <br /> (when full)plus 10% of total capacity. The operator may also provide photo documentation that <br /> all containers have been removed from the site within 90 days of the date of this report. <br /> • The operator is responsible for the removal of these containers. Due to deep snow cover <br /> the operator was unable to complete this task within the required timeframe of this <br /> response. The operator will provide documentation of the required actions outlined above <br /> when snowmelt makes this task feasible. <br />
