MANAGEMENT <br />February 6, 2019 <br />Clayton Wein <br />Division of Reclamation, Mining & Safety <br />1313 Sherman St., Room 215 <br />Denver, CO 80203 <br />Re: CAM -Colorado, LLC <br />Fruita Loadout - Permit Term <br />Permit No. C-2010-088 <br />Dear Mr. Wein: <br />By letter dated September 12, 2016, DRMS approved CAM -Colorado, LLC's (CAM) request of an <br />extension of time to commence surface coal mining and reclamation operations atthe Fruita Loadout as <br />required by Rules 2.01.5(2)(a) -(b). Although the extension of time ends in September 2019, CAM would <br />like to move the extension date back to the permit anniversary date of March 6th. Rule 2.01.5(b) states <br />the Division or Board may grant reasonable extensions of time for commencement of these operations, <br />upon receipt of a written statement showing that such extensions of time are necessary. <br />CAM believes the local coal market has improved to some extent based on the reduction in coal <br />production and capacity in the North Fork Valley. The Oxbow mine is reclaimed and the Bowie mine is in <br />temporary cessation. CAM has begun talks with BLM about opening a new mine portal in what is known <br />as Coyote Wash. Preliminary response from BLM is positive. CAM will haul coal from the new portal to <br />the Fruita loadout. The design and permitting process will take a few years. CAM will commence <br />construction of the Fruita Loadout after necessary permits and approvals are obtained for the new <br />portal. On behalf of CAM, please extend the timeframe for the commencement of surface coal mining <br />operations at the Fruita Loadout three years from March 6, 2019 to March 6, 2022. <br />Please let me know if you have any questions. <br />Sincerely, <br />J.
