copy of the approved Boulder County permit) to the Division's satisfaction <br />that the appropriate Boulder County permit, addressing repair and <br />stabilization of the damaged portion of Sunshine Canyon Drive, has been <br />attained; <br />B. Colorado Milling Company, LLC shall, within fifteen days of issuance of <br />the Boulder County permit, complete the plans as approved in the Boulder <br />County permit; and <br />C. Colorado Milling Company, LLC shall, within sixty days of the effective <br />date of this Order, file with the Division a permit conversion or amendment <br />application to ensure that all lands affected by the mining reclamation <br />activities, including the Times Mine adit and all aspects of the water <br />pipeline from Left Hand Creek to Gold Hill Mill, are located within an <br />approved affected land boundary and addressed by a reclamation plan <br />and appropriate performance and financial warranties. Operator shall <br />diligently pursue and attain the Division's approval and issuance of the <br />application within statutory deadlines. <br />5. The Order also assessed civil penalties in the amount of $2,850, with all but <br />$100 suspended pending compliance with the corrective actions. <br />6. Operator paid the unsuspended portion of the civil penalty on November 29, <br />2017. <br />7. On December 19, 2017, Operator submitted an amendment application <br />(AM -1) to increase the permitted area by 0.8 Acres to include the Left Hand Creek pump <br />station, water pipeline, and Times Mine portal, as required by the Order. <br />8. AM -1 was filed for review on January 4, 2018 with the decision date set for <br />February 5, 2018. <br />9. During the public comment period which closed on January 24, 2018, the <br />Division received three support letters, eight objection letters, and two agency comment <br />letters. <br />10. On January 26, 2018, the Division sent Operator the first adequacy review <br />letter for AM -1. <br />11. Operator subsequently requested four separate 60 -day extensions and one <br />90 -day extension of the AM -1 decision date. <br />12.
