Current Status: Notice of Closure from CDPHE-WQCD, dated December 11,2015 Actions Taken to Abate Violation: Answer and Request for Hearing filed May 9, 2014. A series of phone, mail, and email communications followed in an attempt to resolve the matter, ultimately resulting in a Compliance Order on Consent, signed on April 9, 2015, and payment of a civil penalty of$13,090. Final Resolution: TC submitted payment for the$13,090.00, and Notice of Closure was issued December 11, 2015. The description shall identify those documents by type and date of execution, identify the specific lands to which the document pertains, and explain the legal rights claimed b the RESPONSE Federal Lands TC will not enter Federal coal or Federal surface lands without first obtaining a required mining plan approval from the Secretary of Interior as provided for in the Colorado Cooperative Agreement at 30 CFR 906.30.
