Current Status: Notice of Closure from CDPHE-WQCD, dated December 11,2015 <br /> Actions Taken to Abate Violation: Answer and Request for Hearing filed May 9, 2014. A series of phone, mail, and <br /> email communications followed in an attempt to resolve the matter, ultimately resulting in a Compliance Order on <br /> Consent, signed on April 9, 2015, and payment of a civil penalty of$13,090. <br /> Final Resolution: TC submitted payment for the$13,090.00, and Notice of Closure was issued December 11, 2015. <br /> Rule 2.03.6-Ri2ht of Entry and Operation Information <br /> (1) Each application shall contain a complete and detailed legal description of the proposed permit boundary, a <br /> description of the documents upon which the applicant bases his or her legal right to enter and begin surface coal <br /> mining operations in the permit area, and a statement as to whether that right is the subject of pending litigation. <br /> The description shall identify those documents by type and date of execution, identify the specific lands to which <br /> the document pertains, and explain the legal rights claimed b the <br /> RESPONSE <br /> Federal Lands <br /> TC will not enter Federal coal or Federal surface lands without first obtaining a required mining plan approval from <br /> the Secretary of Interior as provided for in the Colorado Cooperative Agreement at 30 CFR 906.30.
