Please submit the wildlife statement prepared by the Colorado Parks and Wildlife
(formally known as Colorado Division of Wildlife) in accordance with Rule
6.3.2(d).
b. DRMS response: This item remains outstanding at this time. DRMS has
also reached out to Colorado Parks and Wildlife in an attempt to obtain the
required statement.
Response:
We sent the CDPW a wildlife statement for their review by certified mail. To date we
have not received a reply.
Exhibit L—Rule 6.3.12.Permanent Man-Made Structures:
15. In accordance with 6.3.12,please provide information sufficient information to
demonstrate that the stability of any structures located within two hundred(200)
feet of the operation or affected and will not be adversely affected.
c. Applicant Response: Please see previous response dated February 7,2019.
d. DRMS Response: The applicant only submitted one structure agreement for
historic Old Town Mine Road between Venture Resources, Inc. and Old Town
Mine, LLC However, Exhibit L indicates there are four additional owners of this
road. Please either submit completed structure agreements for the road with all
of the owners or provide information sufficient to demonstrate that the stability of
the road will not be adversely affected.
Response:
We have revised Exhibit L to clarify the proposed Old Town Waste Rock pile will be
removed without excavation into the original topography to any significant extent. The
intent of the removal operation is to take only the waste rock. There may be some minor,
inadvertent removal of natural material during the final or last level of waste rock
removal. The underlying material is not ore bearing material. Its removal will not yield
any of the gold, silver, lead or zinc which may be found in the overlying waste rock.
2
