be responsible for maintaining this road, except that Lessee shah be liable for any <br />damage to this road in excess of ordinary wear and tear resulting from Lessee's <br />negligence. Lessee shall maintain any other road(s) an the Property utilized by <br />Lessee (subject to realignment rights under subsection 1.2), and shall maintain the <br />remainder of the Property then occupied by Lessee and not excavated by Lessee's <br />operations, in no worse condition than when the same were made available to <br />Lessee, except that Lessee shall not be responsible for maintenance or repair of <br />any road due to any act of God or any act or omission by anyone other than <br />Lessee or other person or entity using a road pursuant Lessee's rights under this <br />Lease. <br />6.7 Lessee shall construct and maintain any fences on the Property required by <br />governmental requirements applicable to Lessee's operations. These fences shall <br />be removed by Lessee at its expense upon termination of this Lease, if requested <br />by Lessor in writing within 60 days after termination and permitted by the <br />applicable federal, state and local laws and regulatio4s. <br />6.8 Lessee will pay when due all assessments and other charges associated with the <br />Water Rights during the Term until the commencement of reclamation under <br />Section 9, at which time responsibility for the same shall shift: to Lessor. <br />7. Lessor's Obligations and Ex nses. <br />7.1 Lessor shall be solely responsible for obtaining and maintaining all Water Rights <br />and any and all water well permits, substitute water supply plans, and <br />augmentation plans necessary or convenient for the Business. Additionally, <br />Lessor shall be solely responsible for obtaining and maintaining any water supply <br />contracts or other sources of augmentation water necessary to support the <br />augmentation Plan(s) or substitute water supply plan(s) for the Business. Lessor <br />covenants and guaranties that, during the Term, Lessor will take all reasonable <br />actions to maintain all water rights appurtenant to the Property, provided that <br />Lessee reasonably assists Lessor in these efforts. <br />7.2 Lessor shall pay in a timely fashion all real property taxes and assessments upon <br />the Property. <br />8. Insurance. <br />8.1 Except as stated in subsection 8.2, at all times during the Term Lessee at its <br />expense shall procure and maintain the following insurance: <br />(a) Workers Compensation insurance (including occupational disease and <br />disability insurance) as required by law; and <br />(b) Commercial general liability insurance covering bodily injury and <br />property damage with limits of $1,000,000 per occurrence and general <br />aggregate coverage of not less than $2,000,000, plus umbrella coverage <br />from excess liability with aggregate coverage of at least $5,000,000.
