1.2 Lessee, at its sole expense, may realign any existing unpaved roadways and create <br />other roads on the Property. Lessee shall pay all costs and expenses for <br />governmental approvals, construction, maintenance, repair, alteration, <br />realignment and improvement of any existing unpaved road on the Property and <br />any new road created by Lessee pursuant to the rights granted in this subsection <br />1.2. All existing and subsequently created unpaved roads shall at all times be <br />graded and crowned and otherwise maintained and repaired as necessary to avoid <br />noticeable "washboard" buildup and to minimize erosion to the extent practicable. <br />1.3 Upon termination of this Lease by expiration of the Term (defined below) or <br />otherwise, Lessee shall remove from the Property all Common Materials <br />stockpiled or located on the Property, subject to paragraph 1.4(a). <br />1.4 Lessee is granted the right to enter or remain on the Property after termination of <br />this Lease for the following limited purposes: <br />(a) For a period of up to 90 days in order to remove Lessee's property used in <br />the Business as described in Section 9 and all Common Materials on the <br />Property at the time of termination of this Lease, provided that Royalties <br />in accordance with the provisions of this Lease shall be paid upon all <br />Common Materials removed from the Property under this paragraph 1.4(a) <br />as required by this Lease; and <br />(b) For so long as is reasonably necessary, in compliance with applicable <br />DRMS and any other applicable governmental regulations, to reclaim the <br />Property in accordance with Section 9 and to complete re -vegetation <br />required by any governmental authority in connection with such <br />reclamation. <br />1.5 Lessor's authorized agents and representatives shall at all times have the right, at <br />Lessor's risk and expense, to enter the Property: (a) to inspect the Property; (b) to <br />observe, review or investigate operations under this Lease; (c) to monitor <br />weighing procedures; and (d) for any other purpose. Lessor will in exercising its <br />rights to enter the Property during the Term of this Lease seek to minimize <br />interference with Lessee's operations on the Property, and Lessee will cooperate <br />with Lessor for that purpose. <br />2. Permits. <br />2.1 Within a reasonable time after the Commencement Date (defined below) Lessee <br />shall transfer DRMS Permit Number M-2009-048 into its name and post the <br />reclamation bond required under such permit. <br />2.2 Within a reasonable time after the Commencement Date Lessor and Lessee shall <br />work together to ensure that the following permits are transferred to or assumed <br />by Lessee: (a) Colorado State Construction Air Permits for Pit I and Pit 5 (GRP <br />#1 - 09ME0814F) (GRP 45 - I1ME3210F); (b) Colorado Division of Water <br />2 <br />
