Virginia Ave. <br />Gunnison, CO 81230 <br />To Whom It May Concern: <br />The Elk Creek Mine, owned by Oxbow Mining, LLC (Oxbow), ceased coal production in <br />December of 2013, and the mine portals were seated in December of 2015. Since the sealing of the mine, <br />Oxbow has been conducting final reclamation activities. Oxbow continues to maintain a Mining Permit <br />(C-1981-022) with the Colorado Division of Reclamation, Mining and Safety (CDRMS). <br />One provision of the CDRMS Rules is that the mine must be bonded for the estimated <br />reclamation cost. The current reclamation bond value held for Oxbow is $4,500,000.00 and is in the form <br />of a Corporate Surety. Oxbow is requesting a partial release of $398,000 for reclamation work that has <br />been completed. In accordance with CDRMS rule 3.03.2(1), Oxbow is required to send written notice of <br />the partial bond release request to adjacent land owners, surface owners and various local governing <br />bodies. <br />Oxbow has completed reclamation of the Middle and Lower Pad areas of the Elk Creek <br />Mine. Items removed from these areas include the Lamp house, Intake and Belt Portal Structure, <br />Shop, Tank Farm and Wash Bay, CV -1 Belt Drive Structure, Stack Tubes and Reclaim Tunnel, <br />portions of Sanborn Creek's Mine Conveyor system, and all associated pads and footings. Two <br />portions of the Elk Creek have been re-established. The areas have been back filled and graded, <br />top soiled and seeded. <br />Oxbow is requesting a partial Phase 1 bond release for the work completed in these areas. These <br />areas are to be returned to an undeveloped land post mining land use. A phase 1 bond release is being <br />requested. <br />The combined 20.6 acre area of the two sites are located in Gunnison County in the SWI/4 of <br />NEIA, NWl/4 of SEI/4, SWI/4 of SEI/4 and SEI/4 of SEI/4 of Section 8 of Colorado Township <br />13 South, Range 90 West, of the 6`h prime meridian. The land areas are owned by Oxbow Mining, LLC, <br />and are located within the interior of the Oxbow Mining property.
