PERMIT#: M-2002-120 <br /> INSPECTOR'S INITIALS: ECS <br /> INSPECTION DATE: February 19,2019 <br /> INSPECTION TOPIC:Trash on site <br /> PROBLEM/POSSIBLE VIOLATION: Problem: Trash and refuse was present on the site. This is a problem at this <br /> time for failure to dispose of refuse in a manner that controls unsightliness or deleterious effects of such refuse <br /> pursuant to C.R.S. 34-32.5-116(4)(e). <br /> CORRECTIVE ACTIONS: The operator shall submit a written notice to the Division with photo documentation, <br /> that the trash has been removed from the site by the corrective action date. <br /> CORRECTIVE ACTION DUE DATE: 3/29/19 <br /> INSPECTION TOPIC: Signs & Markers <br /> PROBLEM/POSSIBLE VIOLATION: Problem:The affected area boundary markers are missing or incorrectly <br /> placed. This is a problem for failure to maintain boundary markers around the affected area as required by <br /> Section 3.1.12(2) of the rule. <br /> CORRECTIVE ACTIONS:The operator shall conduct a survey and replace the boundary markers in the correct <br /> location(s). The operator shall provide proof to the Division that this has been done by the corrective action <br /> date. <br /> CORRECTIVE ACTION DUE DATE: 3/29/19 <br /> OBSERVATIONS <br /> This was a routine monitoring inspection conducted by DRMS at the Hall Irwin Bernhardt Resource site. There <br /> are 286.14 acres currently permitted at this 112c site. The inspection was conducted by Eric Scott of DRMS. <br /> The DRMS representative traveled to the site with permittee representative Mark Johnson of Bestway <br /> Concrete at approximately 1145. The site has been very active since the previous inspection in 2015. Cells 3, <br /> 4 have been slurry wall lined and reportedly approved by the SEO. Cell 5 has been lined and was undergoing <br /> testing during this inspection. Cell 3 has been mined out and almost fully re-sloped, and the south side of Cell <br /> 4 is currently being mined. It does not appear that any significant activity has occurred in the Cell 1 area since <br /> the prior inspection in 2015. <br /> During the inspection and subsequent file review several items were noted that will require correction as <br /> noted above on pages 1 and 2 of this report <br /> 1) Unless the operator can provide documentation to demonstrate otherwise, that it appears that <br /> Stipulation #3 for this permit has been violated. Stipulation #3 states "The operator shall not mine <br /> outside the Pod (cell) 1 until they prove to the satisfaction of the Division of Minerals and Geology that <br /> their mine plan has clearance through the U.S. Fish and Wildlife Service" (due to concerns about <br /> Preebles Jumping Mouse Habitat). This may be construed as failure to follow the approved mining <br /> plan. This stipulation was specifically pointed out to the operator in the Divisions' inspection report for <br /> this site in February of 2015— prior to activity in Cells 3, 4 and 5. <br /> 2) Trash on site was noted in several areas as shown in Photo 2. This includes inoperable vehicles, flood <br /> debris, waste concrete, and other misc. waste items. These items will need to be removed from the <br /> permit and disposed of properly by the corrective action date given (3/29/19). <br /> Page 2 of 4 <br />
