rC*DhR RO '! <br />February 8, 2019 <br />COLORADO <br />Division of Reclamation, <br />Mining and Safety <br />Department of Natural Resources <br />1313 Sherman Street, Room 215 <br />Denver, CO 80203 <br />Jerry Nettleton <br />Twenty Mile Coal Company <br />29515 Routt County Road #27 <br />Oak Creek, CO 80467 <br />RE: Foidel Creek Mine; C-1982-056: Technical Revision No. 92 (TR92) <br />Final Adequacy Review <br />Dear Mr. Nettleton: <br />The Colorado Division of Reclamation, Mining, and Safety (Division) has reviewed the responses and <br />submissions of TR 92, which was found complete on 10/24/2018. The first adequacy letter was sent <br />11/21/2018. The responses were received 12/19/2018. <br />The Second Adequacy Review was in regards to a comment letter received on November 9, 2018 from <br />the Office of Archaeology and Historic Preservation, which was forwarded to you via email on November <br />13, 2018. The letter notes that while there are no surface facilities planned at present, there may be <br />potential subsidence impacts. <br />The letter states that a search of the Colorado Cultural Resource Inventory Database indicates that 7 <br />cultural resource inventories have been conducted in the vicinity of the proposed area to be added to the <br />existing permit, and 2 cultural resources which may be eligible for listing to the National Register of <br />Historic Places have been recorded therein. Files contain incomplete information for this area and for this <br />area and there is the possibility that as yet unidentified cultural resources exist within the proposed permit <br />area. <br />1. Please address the issues from the above stated comment letter with documentation to be placed <br />in the PAP. <br />Operator will gather additional archaeological data when weather allows. The decision date for this <br />revision was extended to 6/1/2019. <br />2/8/2019 <br />Per the operator's request in regards to mine plan schedule the 7 -East Longwall Panel development <br />activities (gate -roads) are projected to move into the 7 -East extension area in March or April of 2019. <br />Longwall mining is not projected to begin in the 7 -East Panel until October of 2019. <br />The Division has approved TR92 with the following stipulation (#67): <br />Operator must complete the supplemental cultural resource survey for the expansion of panel 7 Right LW <br />Panel 3 (7 East Panel) to satisfy the concerns/obligations of the Office of Archaeology and Historic <br />flF'C-0 <br />H <br />1313 Sherman Street, Room 215, Denver, CO 80203 P 303.866.3567 F 303.832.8106 http://mining.state.co.us I <br />Jared Polis, Governor I Virginia Brannon, Director * r 1876 4 <br />
