BEFORE THE MINED LAND RECLAMATION BOARD <br />STATE OF COLORADO <br />FINDINGS OF FACT, CONCLUSIONS OF LAW, AND ORDER <br />IN THE MATTER OF THE REQUEST OF CRIPPLE CREEK & VICTOR <br />GOLD MINING COMPANY FOR A FIVE-YEAR PERIOD OF <br />TEMPORARY CESSATION, File No. M-2012-052 <br />THIS MATTER came before the Mined Land Reclamation Board ("Board") on <br />January 23, 2019 as a consent agenda item regarding the request for an initial period <br />of temporary cessation filed by Cripple Creek & Victor Gold Mining Company <br />("Operator") for the Providence Mine, file number M-2012-052 ("permit). <br />The Board, being fully informed of the facts in the matter, enters the <br />following: <br />FINDINGS OF FACT <br />1. Operator holds a 110(d) reclamation permit for 9.93 acres of gold and <br />silver mining. The site is known as the Providence Mine. The site is a designated <br />mining operation and is located in Teller County, Township 15 South, Range 69 <br />West, Section 18, 6th Principal Meridian. <br />2. Operator submitted a notice for an initial period of Temporary <br />Cessation for the site, requesting an effective date of July 5, 2018. <br />3. No objections from any parties were received. <br />4. The Division supports Operator's an initial period of Temporary <br />Cessation. <br />CONCLUSIONS OF LAW <br />5. The Board has jurisdiction over this matter pursuant to the Mined <br />Land Reclamation Act, Article 32 of Title 34, C.R.S. ("Act"). <br />6. Under section 34-32-103(6)(a), C.R.S., an operator may temporarily <br />cease production upon compliance with the notice requirements therein. <br />7. Rule 1. 13.5(2) of the Mineral Rules and Regulations of the Colorado <br />Mined Land Reclamation Board ("Rules") requires a notice for an initial period of <br />Temporary Cessation to include the date of cessation, reasons for non -production or <br />cessation, a plan for resumption of mining, measures to be taken to comply with <br />reclamation requirements or other performance standards while the mine is in <br />
