November 14,2018
Mr.Frank Ferris
P.O.Box 628
Nucla,CO 81424
Dear Mr.Ferris
Per our previous discussions, this letter is to serve as formal notification that as a surface
landowner, i would like the C18 Ditch on my property, once backfilled and graded, to be
retained as a road and not an irrigated pasture reclamation unit.
Rule 1.04(71)states, "...All of the land uses defined below may include land used for support
facilities which are adjacent to, or are an integral part of the land..."Retention of the backfilled
and graded C18 Ditch on my property will be utilized as a support facility(i.e.road). This road
will be directly adjacent to long-term irrigated pasture reclamation areas on the southern end of
the irrigated pasture areas on my property, and will provide access for me to manage my
property into the future. Retaining this area as a road instead of a reclamation parcel is a
considerable benefit to for me to manage my property,as I deem appropriate.
Sincerely,
Mel Staats
Page 7 January 2019 (TR-85)
