2.05.5 <br />(a)(iii) The proposed surface coal mining and reclamation operations are consistent with the <br />surface owner plans and programs. Most of the surface where disturbance has or will <br />occur is owned by the applicant. The applicant plans to utilize the surface to support <br />underground coal mining operations until the resource is depleted. When coal mining is <br />complete the applicant plans to restore the surface to its highest and best use which is <br />currently considered to be rangeland and wildlife habitat. <br />(b) The Applicant and landowner are the same and through this permit application <br />approve the proposed postmining land use. The BLM and USDA -FS review the <br />permit and have not objected to the proposed postmining land use. The Division <br />is the State agency which must approve the permit application so its issuance of <br />a permit will be considered its approval of the proposed postmining land use. <br />The permit and adjacent areas are in Delta County. Delta County <br />implemented specific development regulations, effective October, 2000. <br />The Delta County planning department does not have land use <br />classifications that would be applicable to this section. Senior Planner Dave <br />Rice (May 25, 2010) verbally indicated the land use classifications in the <br />permit and adjacent area would be residential, agricultural, industrial and <br />public lands. <br />(c) A postmining land use map is presented in Volume II, Map 13. <br />PR -14 2.05 -86- 03/14 <br />
