A decision date will be established 90 days from the date of receipt of all of the requested <br /> information. Additionally, if you have already published notice you will need to republish notice,after the Division <br /> considers the application submitted. This notice must be published once a week for four(4)consecutive weeks, <br /> starting within ten(10)days of the date your application is considered submitted. We will notify you when you <br /> should initiate republication of your notice. The final date for receiving comments is the 20th day after the fourth <br /> publication or the next regular business day. <br /> You have sixty(60)days from the above date to submit all necessary documents that the Office needs for an <br /> application to be considered filed. If, at the end of the sixty day period,the application has not been determined to <br /> be filed with the Office,the Office shall deny the application and terminate the application file. Because this <br /> amendment is required to resolve outstanding corrective actions,failure to submit an amendment that is able to be <br /> approved within the statutory timeframe will result in enforcement actions. <br /> It was also noted that the amendment was submitted listing Arcosa LWB, LLC as the Applicant/Operator,not <br /> TRNLWB as the Division's records currently indicate. As we discussed on the phone yesterday,due to the name <br /> change you will be required to submit an approvable Succession of Operator revision to change the name of the <br /> Permittee or DRMS will not be able to approve this amendment. <br /> There also appears to be a significant discrepancy between the currently permitted acreage(181.21),the acreages <br /> listed in Item 3 of the application form(108.04 current,and 31 to be amended for a total of 139.04)and the acreage <br /> shown on the provided map(appears to be a total of 170). This issue will need to be resolved and corrected as <br /> needed. <br /> This letter shall not be construed to mean that there are no other technical deficiencies in your application.
