Aggregate Industries South Platte Combined SWSP January 30, 2019 <br />Plan IDs 3614, 4773, 3624, 4772, 4616, 3437, 3376, 3650, 3668, and 5475 Page 17 of 21 <br /> <br />8.Conveyance loss for delivery of replacement water is subject to assessment and modification <br />as determined by the division engineer. The distance for assessment of conveyance loss will <br />be based upon DWR stream miles or as approved by the Water Commissioner, and will be <br />assessed from the point of release to the point of depletion/replacement. <br />9.The replacement water, which is the subject of this plan cannot be sold or leased to any <br />other entity. As a condition of subsequent renewals of this substitute water supply plan, the <br />replacement water must be appurtenant to these sites until a plan or plans for augmentation <br />are obtained. All replacement water must be concurrent with depletions in quantity, timing, <br />and locations. According to an affidavit dated February 29, 2012, the Applicant dedicated the <br />13.5 shares of the Whitney Ditch Company and 96 shares of the Fulton Irrigating Ditch <br />Company as replacement water solely for this SWSP for as long as there are depletions at <br />these gravel pit sites or until such time as another replacement source is obtained. For the <br />purposes of this SWSP, this affidavit will be accepted for the dedication of the shares; <br />however, if the State Engineer determines that a different affidavit or dedication process is <br />necessary to assure proper dedication of the shares, additional information may be required <br />prior to future SWSP approvals. <br />10.All diversions shall be measured in a manner acceptable to the division engineer. The <br />Applicant shall install and have approved by the Water Commissioner all structures prior to <br />any credit or use in this SWSP. Applicant shall maintain such measuring devices as required <br />by the division engineer for operation of this SWSP. In addition, the applicant shall maintain <br />daily records of all diversions, replacements, and the amount of water used for each <br />particular purpose. The applicant shall provide a report of these records to the division <br />engineer and the water commissioner on a monthly basis, or more frequent as required, on a <br />form approved by them. The accounting must be submitted to the division engineer in <br />Greeley (DNR_Div1Accounting@state.co.us) and the water commissioners [Jorge Vidal <br />(Jorge.Vidal@state.co.us), Mark Simpson (Mark.Simpson@state.co.us), Shera Sumerford <br />(Shera.Sumerford@state.co.us), and Bob Carlson (Bob.Carlson@state.co.us)] within 30 <br />calendar days of the end of the month for which the accounting is being made. Submitted <br />accounting shall conform to the Administration Protocol “Augmentation Plan Accounting, <br />Division One – South Platte River” (attached). <br />In addition, the applicant shall verify that each entity making replacements for this plan, <br />have included this plan in their respective accounting submitted to the division engineer. For <br />this plan period those entities are the Centennial Water and Sanitation District, City of <br />Westminster, and City of Thornton. <br />11.The installation of any device used for measuring replacement water in this plan must be <br />inspected by a Division 1 hydrographer. Furthermore, the exact location of all return <br />structures utilized in this plan must be provided to the division engineer and appropriate <br />water commissioner in order to allow for inspections of the structures. Finally, all charts or <br />other output data associated with each measuring device utilized in this plan must be <br />provided in a timely manner acceptable to all of the water commissioners identified herein. <br />12.The Applicant shall be required to notify and obtain approval of the Water Commissioners in <br />writing a minimum of 48 hours, or as required by each individual Water Commissioner, of all <br />planned releases and exchanges, including but not limited to, location, amount, and timing <br />(start and end dates).
