notice of non-compliance. A decision or notice of non-compliance issued by the lessor that <br />payment is due under this stipulation is appealable as allowed by law. <br />(d) Wildlife Resources. (1) Prior to the authorization of surface disturbance, raptor nest <br />survey will be required within 1 mile of project -related activities for fezruginous hawks and <br />golden eagles, and within 300 meters of the project -related activities for woodland nesting <br />raptors, red-tailed hawk, and burrowing owls. If the lessee elects to perform these surveys, they <br />must be conducted consistent with most -current WRFO raptor nest survey protocols (available <br />from WRFO). Functional nests found in the course of these surveys will be subject to the <br />development of conditions of approval in order to protect the integrity of existing nest sites and <br />ongoing nesting efforts. <br />(2) No development activities are allowed within 0.5 miles of golden eagle nests, and <br />0.25 mile of other raptor species from February 1 to 15 August or until fledging and dispersal of <br />young. These stipulations are subject to exception and modification provisions established in the <br />1997 White River RMP (TL -02 and TL -04. These Timing Limitation (TL) stipulations currently <br />apply to the following legal subdivisions: <br />COC -023703-01 <br />T2N, R101 W, 6`h PM <br />Section 3: SESW and NESW <br />(3) No development activities are allowed within CPW-designated big <br />winter range from January 1 to April 30. This stipulation is subject to exception and modification <br />Provisions established in the 1997 White River RMP (TL -08).
