BEFORE THE MINED LAND RECLAMATION BOARD <br />STATE OF COLORADO <br />Notice of Violation No. MV -2018-047 <br />FINDINGS OF FACT, CONCLUSIONS OF LAW, AND ORDER <br />IN THE MATTER OF A POSSIBLE VIOLATION BY LOCKLAND, LLC, CEASE <br />AND DESIST ORDER, CORRECTIVE ACTIONS, AND CIVIL PENALTIES FOR <br />FAILING TO POST ADDITIONAL FINANCIAL WARRANTY WITHIN SIXTY <br />DAYS OF THE DATE OF NOTICE OF ADJUSTMENT, File No. M-2013-026 <br />THIS MATTER came before the Mined Land Reclamation Board ("Board") on <br />December 12, 2018 in Denver, Colorado to consider a possible violation by Lockland, <br />LLC ("Operator"), cease and desist order, corrective actions, and civil penalties for <br />failing to post additional financial warranty within sixty days of notice of adjustment, <br />file number M-2013-026. Robert Calder appeared on behalf of the Operator. Dustin <br />Czapla appeared on behalf of the Division of Reclamation, Mining and Safety <br />("Division"). <br />The Board, having considered the parties' presentations, the materials <br />presented, and being otherwise fully informed of the facts in the matter, enters <br />the following: <br />FINDINGS OF FACT <br />1. Operator holds a 110(2) permit for a 9.9 -acre gold mining and tourist <br />mine operation located in Section 20, Township 9 North, Range 79 West, 6th <br />Principal Meridian in Lake County, Colorado, permit number M-2013-026. The <br />mine is located on both federal and private land and consists of two shafts, the <br />Hopemore Shaft and the Hunter Shaft. The portion of the permitted area <br />containing the Hopemore Shaft is located on federal land overseen by the Bureau of <br />Land Management (`BLM"). <br />2. On June 26, 2018, the Division conducted a routine inspection of the <br />site. Robert Caulder, representing Operator, and Amber Sanderson, representing <br />the BLM, were present during the inspection. The Division did not find any <br />violations or problems at the site during the inspection. The inspection report, <br />signed July 10, 2018, informed Operator that the Division would review reclamation <br />costs for the site to determine if the financial warranty accurately reflected the cost <br />of reclamation. <br />
