1'1 <br />Based on the foregoing findings of fact and conclusions of law, the Board <br />hereby finds Steven Hunter in violation of section 34-32-109(1), C.R.S. for engaging <br />in a mining operation without first obtaining a reclamation permit. <br />Steven Hunter shall CEASE AND DESIST any further mining activities at <br />the site, except those activities approved by the Division, in writing as necessary to <br />prevent further damage to off-site areas or to protect health and safety until <br />corrective actions have been resolved to the satisfaction of the Division. <br />The Board imposes against Steven Hunter the following CORRECTIVE <br />ACTION: Operator shall submit to the Division a 110(1) Reclamation Only permit <br />application, complete for filing purposes, within ninety days of the mailing date of <br />this Order and obtain approval of the application within statutory deadlines. The <br />permit application shall include, at minimum, a plan for reclamation of all affected <br />areas impacted by the mining activity, and bringing the three associated structures <br />into compliance with local zoning and building regulations or removing them from <br />the property. <br />The Board imposes a CIVIL PENALTY of $5,000 pursuant to section 34-32- <br />123(3), C.R.S. All but $500 of the total assessed civil penalty is suspended if the <br />Operator complies with the corrective action in the time specified. The portion of <br />the civil penalty not suspended, $500, shall be due and payable within thirty days of <br />the effective date of this Order.
