("Tri-State"), is the parent <br />company to Axial Basin Coal Company, which is the general partner to Colowyo Coal Company <br />L.P. ("Colowyo"). Colowyo is the surface landowner for the Taylor Creek Access Road, which <br />traverses along Taylor Creek from Haul Road A to the East Taylor Pond. <br />Rule 4.03.2(g) of the Regulations of the Colorado Mined Land Reclamation Board for <br />Coal Mining require that all access roads be removed and the affected land be reclaimed. <br />However, a surface landowner can request in writing, under Rule 4.03.2(g)(ii), that the access <br />road or parts of the road be left open for further use. <br />I, Barry Ingold, as representative of Tri-State and the surface landowner Colowyo, hereby <br />request that the Taylor Creek Access Road remain as a permanent road, and be released from the <br />reclamation liability as required under Rule 4.03.2(g). The Taylor Creek Access Road is an <br />integral part of Tri -State's land management activities as it is currently, and will be post mine, <br />the only access point and road available for Tri-State to manage its property in the upper reaches <br />of the Taylor Creek drainage. <br />If you have any further questions or concerns please feel free to call me at (303) 254- <br />3313.
