9. The Division has reviewed the reclamation cost estimate included in Attachment VI.
The estimate did not include the mulching plan outlined in the reclamation plan,
equipment mobilization and applicable indirect costs. The Division has conducted
a reclamation cost estimate based on the proposed reclamation plan; it is enclosed
for your review. Please indicate if the applicant concurs with the estimate.
Response:
We concur with the estimate.
10. Though not specifically stated on page 43 of the application, the Operator will be
required to comply the time limits for reclamation required by Rule 3.1.3(2).
Please affirm this is understood.
Response:
We understand that we must adhere to the time limits for reclamation laid out in Rule
3.1.3(2). However,we do not waive the provisions of CRS 34-32.5-112(6)which allow
the Board, for good cause,to extend the period for site reclamation.
11. Section 3.1.11 indicates on page 52 that there are no building on site. Based on the
pre-operation inspection and the El-a,d,f map there is a "Shaft Head Gear and Ore
Bine" on site. Even though these structures are not part of the current operation, it
would be good to note they currently exist on the site and that they will remain
onsite at the conclusion of the operation. Please revise Section 3.1.11,page 52
accordingly.
Response:
Page 52 has been revised to read as follows:
"The only structures within the proposed permit boundary are the very old Shaft Head Gear
and Ore Bin. They will be left.No other structures are planned or will be left."
12. Under the notes section of the reclamation plan map(E-3), there is a note that says
"No reclamation". It is unclear what this note is referring to. Please remove this
citation on the map as there is not an area currently proposed that will not be
reclaimed
Response:
The note on the Reclamation Plan Map"No Reclamation"refers only to the ephemeral
creek bed. It is not meant to refer to any other area of the site. The map has been revised
to clarify the note.
