The mine as of the writing of this mid-term review document <br />continues to be in Temporary Cessation. <br /> <br />On May 31, 2011 the Division approved a permit renew al (RN-07) for a new permit term expiring <br />July 6, 2016. <br /> <br />On February 3, 2017, the Division approved Permit Revision PR-02 which reduced the approved <br />Affected Area by 258.10 acres (database error adjustment), but increased the approved Permit <br />Area by 1,000.90 acres. <br /> <br />On November 26, 2018 the Division approved a permit renewal (RN-08) for a new permit term <br />expiring on July 6, 2021. The projected date of issuance for the RN-08 permit is January 2, 2019. <br />There have been no Notices of Violation issued since the May 31, 2011 approval of RN-07 to date. <br /> <br />This midterm review is identified as Midterm Review No. 8 in the Division’s Permit System. This <br />document, however, is actually Midterm Review No. 9, since the Division has completed the Permit <br />Renewal No. 8 for the McClane Canyon Mine , and since mid -terms precede the subsequent permit <br />renewal (Mid-Term Review No. 1 precedes Permit Renewal No. 1; Mid-Term Review No. 2 <br />precedes Permit Renewal No. 2, etc). Please refer to Table No. 1 attached at the end of this <br />review for details of the Division’s record of reviews. In order to remain consistent with the <br />numbering of previous mid-term reviews, this mid-term review will remain MT-08 <br /> <br /> <br /> SECTION II – REVISIONS TO THE PERMIT <br /> <br />The proposed decision for Permit Renewal No. 8 was made on November 26, 2018. The comment <br />period for the renewal will end on midnight December 31, 2018. No revisions to the C-1980-004 permit <br />have been made since the issuance of RN -08. <br /> <br /> <br />SECTION III – STATUS OF STIPULATIONS <br /> <br />Stipulation 27 was attached to Permit Renewal No. 5, and will remain in effect. No additional <br />stipulations were placed on the permit as a result of November 26, 2018 Permit Renewal RN -08. <br /> <br />STIPULATION NO. 27 -- SEDIMENT REMOVED FROM THE SEDIMENT POND MAY BE <br />USED AS A TOPDRESSING OR TOPSOIL SUPPLEMENT PURSUANT TO RULE 4.06.2(4)(A), <br />UPON SUBMITTAL OF CHEMICAL AND PHYSICAL ANALYSES DEMO NSTRATING <br />THAT THE MATERIAL IS EQUAL TO OR MORE SUITABLE FOR SUSTAINING <br />VEGETATION THAN AVAILABLE TOPSOIL OR OTHER PLANT GROWTH MEDIA. SUCH <br />DEMONSTRATION SHALL BE BASED ON A REPRESENTATIVE COMPOSITE SAMPLE OF <br />THE MATERIAL OBTAINED FROM EACH POND CLEAN OUT EPISODE. REQUIRED <br />PARAMETERS WILL INCLUDE THOSE LISTED IN 4.06.2(4)(A), WITH THE EXCEPTION OF <br />THICKNESS, DEPTH, COARSE FRAGMENTS, AND AREAL EXTENT. ANALYSES FOR <br />SELENIUM, BORON, NITROGEN, AND ORGANIC MATTER WILL BE INCLUDED IN <br />ADDITION TO THOSE LISTED. POND CLEAN OUT MATERIAL WILL NOT BE PLACED <br />IN THE TOPSOIL STOCKPILE OR USED AS FINAL RECLAMATION TOPDRESSING <br />PRIOR TO OBTAINING WRITTEN APPROVAL FROM THE DIVISION. <br />
