This
document, however, is actually Midterm Review No. 9, since the Division has completed the Permit
Renewal No. 8 for the McClane Canyon Mine , and since mid -terms precede the subsequent permit
renewal (Mid-Term Review No. 1 precedes Permit Renewal No. 1; Mid-Term Review No. 2
precedes Permit Renewal No. 2, etc). Please refer to Table No. 1 attached at the end of this
review for details of the Division’s record of reviews. In order to remain consistent with the
numbering of previous mid-term reviews, this mid-term review will remain MT-08

SECTION II – REVISIONS TO THE PERMIT

The proposed decision for Permit Renewal No. 8 was made on November 26, 2018. The comment
period for the renewal will end on midnight December 31, 2018. No revisions to the C-1980-004 permit
have been made since the issuance of RN -08.

SECTION III – STATUS OF STIPULATIONS

Stipulation 27 was attached to Permit Renewal No. 5, and will remain in effect. No additional
stipulations were placed on the permit as a result of November 26, 2018 Permit Renewal RN -08.

STIPULATION NO. 27 -- SEDIMENT REMOVED FROM THE SEDIMENT POND MAY BE
USED AS A TOPDRESSING OR TOPSOIL SUPPLEMENT PURSUANT TO RULE 4.06.2(4)(A),
UPON SUBMITTAL OF CHEMICAL AND PHYSICAL ANALYSES DEMO NSTRATING
THAT THE MATERIAL IS EQUAL TO OR MORE SUITABLE FOR SUSTAINING
VEGETATION THAN AVAILABLE TOPSOIL OR OTHER PLANT GROWTH MEDIA.
