<br /> <br />1313 Sherman Street, Room 215 <br />Denver, CO 80203 <br /> <br />4 January 2019 <br /> <br />Miranda Kawcak <br />Peabody Energy, LLC <br />29515 Routt County Road #27 <br />Oak Creek, CO 80467 <br /> <br /> <br /> <br /> <br />RE: Yoast Mine (Permit No. C-1994-082) <br />2017 Annual Hydrology Review <br /> <br /> <br /> <br /> <br />Dear Ms. Kawcak, <br /> <br />The Division has completed its review of the above referenced report having received the hard copy version of <br />the report on 5 April 2018. <br /> <br />Annual Hydrology Report <br /> <br />The Division finds the 2017 Annual Hydrology Report in compliance of the requirements identified in the <br />attached memo. The report fulfills the 2017 requirement to file an annual hydrology report. It is noted that <br />through the Division’s approval a number of monitoring stations have been either permanently or temporarily <br />suspended. Also, Minor Revision 46 (2017), reduced the frequency of Sediment Pond Capacity Surveys, <br />Technical Revision 47 made reductions in the Hydrologic Monitoring Plan and Technical Revision 69 suspended <br />a number of parameters for analysis. <br /> <br />The Division has the following comments: <br />The Division located the Water Quality Report for Point of Compliance YSAL3 in Appendix 3. However, the <br />Division did not find in Appendix 3 the Water Quality Report for Point of Compliance Well SAGL70. <br />1. Please provide the water quality data comprising site SAGL70 for DRMS review, or explain why it was <br />not included or collected. <br />No water quality data was located in the report for the following sites monitored on an annual basis, YTM32, <br />and SGAL70 and SFAL72. <br />2. Please explain when YTM32 went out of service and why. <br />3. Please provide the water quality data comprising points SGAL70 and SFAL72 for DRMS review or, <br />explain why data was not included or collected. <br />Page three of the submitted AHR states: “Water level data are provided in Appendix B. For each well, water <br />level reports for the past ten years are presented immediately after the water level hydrograph for all data <br />since 1991.” This does not appear to be the case, as only one measurement is indicated and the water level <br />appears as zero. <br />4.
