<br /> <br /> <br />5 <br />Status - Stipulation Active . Specified analyses which demonstrated the acceptability of 1992 <br />pond clean out material for use as topsoil were included in the October, 1997, TR -09 submittal. The <br />stipulation will remain in effect, to allow for use of future pond clean out material as topdressing, <br />upon approval by the Division. <br /> <br /> <br />SECTION IV – MIDTERM ADEQUACY QUESTIONS <br /> <br />The Division has the following adequacy comments regarding this Midterm Review. <br /> <br /> <br />1. Please submit an updated officers and directors list for McClane Canyon Mining, LLC if <br />needed. <br />2. Please submit an updated Section 2.1.3 – Production (starting on page 2-3) and associated <br />table (page 2-4) for the production of McClane Mine from 2013 to 2018. <br />3. Please submit an update d Figure 2.1-1, if needed, to reflec t the actual schedule up to 2018 <br />and projected schedule for future years. <br />4. Please submit an updated Figure 2.2-1, if needed, to reflect the current affected ar ea by <br />mining up to the year 2018 and future affected area. <br />5. Please submit and updated Table 3.7-2, if needed, to reflect the current expected <br />reclamation timetable. <br />6. Please submit an upda ted Table 4.3.9 – Threatened and Endangered Species if needed. <br /> <br /> <br /> <br /> SECTION V – PERMIT VARIANCES AND SPECIFIC APPROVALS <br /> <br />The Division has approved a variance from meeting approximate original contour for reclaimed areas. <br />The variance was approved following a demonstration that the requirements of Rule 2.06.4 and 2.06.5 <br />had been met, pursuant to Rule 4.27.3. In addition, the Division found that the applicant had <br />demonstrated that requirements of Rule 4.27.4 would be met. Information upon which these findings <br />were based can be found on pages 3-2 through 3-5 of the permit application. The landowner request <br />from the Bureau of Land Management (BLM), pursuant to Rules 4.27.4(4) and 2.06.5(2)(e), is included <br />in Appendix K, of Volume IV, of the permit application. <br /> <br />The lower portion of the disturbed area will be returned to AOC, but the mine bench area was granted <br />the limited variance, to allow for backfilled slopes of lesser gradient, which would meet applicable <br />stability criteria and support the approved post-mine land use. The mine highwall was completely <br />backfilled, with the natural sandstone outcrop that forms a near vertical face above the portals to <br />remain undisturbed. <br /> <br /> <br />SECTION VI – BONDING SUMMARY <br /> <br />The Division holds an approved bond on behalf of the permittee for the McClane Canyon Mine. The <br />bond is a Corporate Surety from Indemnity National Insurance Company, Bond No. N-072017-C-1980- <br />004, in the amount of $452,909.21. Pursuant to Rule 3.02.2(4), the Division conducted a review of the <br />McClane Mine reclamation liability in association with this midterm permit review. The Division’s <br />reclamation cost estimate for this mid-term review, dated 12/27/2018, is enclosed as Attac hment No. 1.
