EXHIBIT L <br /> Reclamation Cost <br /> Slurry walls have been constructed around Phases 1 through 4 and around Phases 5-12 (North <br /> Mining Area), and have been tested to ensure they meets the design standard in the "State <br /> Engineer Guidelines for Lining Criteria for Gravel Pits". See the attached approval letters from <br /> the State of Colorado Division of Water Resources. At this time Phases 13-17 are being used <br /> solely for stockipiles and sediment ponds. <br /> The financial warranty required for each phase of mining includes cost components for the <br /> areas of scarification of ground, topsoil placement, and revegetation required for that phase. <br /> Direct costs related to the construction of the reclamation components that have been included <br /> in the financial warranty calculations include: Backfill placement, scarifying disturbed ground <br /> surfaces, re-applying topsoil over disturbed areas, revegetating disturbed areas, slurry wall <br /> construction, and contractor mobilization. The slurry wall costs are based on the average depth <br /> of the wall to calculate the per lineal foot cost. <br /> Overhead, profit, and project management costs were then calculated and added to the direct <br /> construction costs to arrive at the required financial warranty for each phase. <br /> The financial warranty for all north mining phases and all disturbed areas has been calculated <br /> for the maximum anticipated disturbed area for the mine. <br /> Please see the attached calculations for details of the costs and quantities used to determine <br /> the financial warranty required for the mine. <br /> Prowers Aggregate Operators will submit a technical revision to the permit for the financial <br /> warranty calculations for the south mining area prior to any extraction of sand and gravel in that <br /> area. PAO commits to providing 100% of the cost to construct the slurry wall in the south mining <br /> area prior to mining below the static groundwater table elevation in the area, or will construct <br /> and obtain approval from the DWR for the slurry wall prior to mining below the static <br /> groundwater table elevation in this area and provide a bond equal to 20% of the cost to <br /> construct the wall until the reclamation of the south mining area is completed. PAO commits to <br /> submitting a technical revision including design drawings of the slurry wall prior to constructing <br /> it. <br /> The following table summarizes the financial warranty required for each phase, and the <br /> cumulative financial warranty that will be provided during any given phase. <br /> Prowers Aggregate Operators, LLC. <br /> J&T Consuiting,Inc.
