(PAO) has received the Division's adequacy review <br /> comments letter dated November 21, 2018. Below are the comments and the corresponding <br /> responses that have been provided to address the comments. <br /> Exhibit A— Legal Description (Rule 6.4.1): <br /> 1) The application describes Parcel B (the sand load-out area adjacent to the railroad) as <br /> containing 23.05 acres more or less. This amount is 3.75 acres less than the amount <br /> estimated by the Division in its June 14, 2018 inspection report. Please confirm the <br /> proposed permit area for Parcel B contains all land disturbed or proposed to be disturbed <br /> by the operation in that area. <br /> Response: Confirmed, the proposed permit area for Parcel B contains all land <br /> disturbed or proposed to be disturbed by the operation in that area. The overall <br /> property boundary area is 23.80 acres for the land in the Parcel B area. A 70-foot <br /> wide strip along the west boundary of the property that contains the Lamar Canal <br /> was excluded from the permit boundary for Parcel B. The excluded area is 0.75 <br /> acres in size, leaving 23.05 acres for the Parcel B permit boundary area. <br /> Exhibit C — Pre-Mining and Mining Plan Map(s) of Affected Lands (Rule 6.4.3): <br /> 2) The Exhibit C — Pre-Mining/Mining Plan Map shows a tailwater pond at the northwest edge <br /> of the site located partially outside of the proposed permit boundary. Please be advised, all <br /> land disturbed by the operation, including stormwater or settling ponds, must be included in <br /> the permit area. Please revise the map to include this pond inside the proposed permit <br /> area. Alternatively, the applicant could revise the amendment application to expand the <br /> permit area to include the pond. <br /> Response: The map has been revised to include the pond inside the proposed <br /> permit area.
