Tony,
Thank you for your correspondence. Due to transitions between Division inspectors over the years, individual
observations do not always make it from one person to the next. The main reason behind the Division documenting this in
the report is to ensure that Colowyo is aware of this observation. As you have stated, Colowyo is aware and currently
monitoring and the Division has no issues or concerns in regards to the East Pit reclamation units at this time. This email
will be included into the public record associated with the December 2018 inspection report. If you have any questions,

In your inspection report for the December 17, 2018 aerial inspection of the Colowyo Mine,you noted some
differential settling in several East Pit reclamation units (EP056 though E58). These three reclamation units were
reclaimed in 2011, 2012, and 2014 respectively. Colowyo has been fully aware of this differential settling along the
highwall in East Pit since it occurred when each of those reclamation units were complete. Colowyo has also been
monitoring this settling in each reclamation unit since reclamation was completed. The settling has not been an
issue long-term and has stabilize over time. No mitigation was necessary as it has been self-healing, and other than
the initial movement no other sliding has occurred. The Division has also been fully aware of this differential
settling, and it is documented in older inspection reports produced by the Division.
Tri-State on behalf of Colowyo would like to ensure the history of these three reclamation units are noted for the
public record, so this differential settling is not misconstrued to be a new issue or something that needs to be
mitigated at this time. I thank you for your time.
