Jared Dains
December 18, 2018
Page 2 of 5
(b) the name and location of all creeks, roads, buildings, oil and gas wells and lines, and
power and communication lines on the area of affected land and within two hundred
(200) feet of all boundaries of such area;
(g) Show the owner's name, type of structures, and location of all permanent or
man-made structures contained on the area of affected land and within two hundred
(200) feet of the affected land.
Please review at least the above sections for completeness and accuracy and revise as
necessary. Please also make sure that all figures comply with the requirements for exhibits
listed in Rule 6.2.1.
EXHIBIT D-Mining Plan (Rule 6.4.4): The mining plan shall supply the following information,
correlated with the affected lands, map(s) and timetables:
(a) description of the method(s)of mining to be employed in each stage of the operation
as related to any surface disturbance on affected lands;
Please note that topsoil must be salvaged and maintained from all affected areas, including
areas to be utilized for stockpiles and roadways, for use in final reclamation.
The permittee will need to commit to the timing for the installation of the slurry wall as it
relates to the mining plan and exposure of groundwater at the site — stating that the slurry
wall will be installed before, or after, mining is insufficient.
The permittee should commit to a maximum working mining slope of 3:1 horizontal to
vertical within the mining plan. The reclamation plan states that mining will take place at 3:1
H:V, but this statement is nowhere in the mining plan as submitted. If nothing is specified
in the mining plan, the Division may need to assume that the entire shoreline/excavated
perimeter will need to be re-sloped from a 1.5:1 working face to a 3:1 reclamation slope and
calculate the bond accordingly. The earthwork required to reconstruct a final reclamation
slope of 3:1 H:V within the excavated area usually constitutes a significant portion of the
reclamation bond.
EXHIBIT E -Reclamation Plan (Rule 6.4.5):
The reclamation/revegetation plan will need to address reclamation for all affected areas,
including access roads and stockpile areas,not just the excavated area as currently provided.
The reclamation plan must provide the amount of pure live seed(PLS)by species, per acre,
to be utilized for revegetation. Be aware that amount of PLS given for drill seeding may be
doubled for broadcast seeding, so be sure to specify what seeding method the amounts given
are intended to be utilized for.
