Summit <br /> Capital has recently corresponded with DRMS, with the Colorado Dept. of Water Resources (DWR), <br /> and with the US Army Corps of Engineers (USACE)regarding adverse impacts from mining by Peak <br /> Materials operation at Maryland Creek Ranch Mine. On November 6, 2018, a letter was sent from <br /> Steffens and Associates, Inc. on behalf of Summit Capital and the owner to DWR (copying DRMS <br /> and USACE) regarding Peak Materials' 2019-20 Substitute Water Supply Plan (SWSP) that <br /> included a dewatering mining method by Peak Materials, even though Peak Materials' current DRMS <br /> permit only allows for wet mining. We requested DWR to address three issues in their review of the <br /> proposed SWSP and the underlying well permit that supports the SWSP. All of those issues relate to <br /> the adverse effects of mining on the Love Pit Wetland located east of Peak Materials' operations and <br /> directly across Colorado Highway 9 from the mine.
