<br />sworn upon oath, deposes and says that he is
<br />the authorized agent of The Chronicle -News,
<br />daily newspaper of general circulation which is
<br />published and circulated in the City of
<br />Trinidad, Las Animas County, Colorado, that
<br />said newspaper is a newspaper of general
<br />circulation complying with all of the requirements

<br />New Elk Coal Company LLC, 12550 highway 12,
<br />Weston, C0 8 109 1, the operator of the New Elk Mine,
<br />Permit number C-81-012, If filling a technical revision of
<br />the New Elk Mine with the State of Colorado. Division of
<br />Reclamation, Mining and Safety. Permit C-81-012
<br />renewal was approved by the Division on April 13, 2009.
<br />For filing purposes, this technical revision appllcatfon was
<br />deemed complete by the Division on September 13,
<br />2019.
<br />The New Elk Mine is located approximately 7 miles west
<br />of Weston, Colorado in Township 33 South, Flange 68
<br />West, in sections 13, 14, 21, 22, 23, 24, 25, 28, and 27.
<br />These sections can be located on the USGS 7.5 minute
<br />Vigil and Weston quadrangle maps. A total of 223.80
<br />acres of surface disturbance from mining related activity
<br />is covered by a Letter of Credit Band and Cash Bond in
<br />the amount of $4,133,137.02.
<br />This technical revlslon is to modify the Well Monitoring
<br />Plan. The monitoring of eight ground monitoring wells is
<br />unnecessary when New Elk Mine is not actively mining.
<br />After mining resumes, New Elk will initiate monitoring the
<br />wells.
<br />The technical revision is an file for public inspection at the
<br />Las Animas Gounty Courthouse, Office of County
<br />Recorder and with the Division of Minerals and Geology.
<br />Any written comments, objections, or requests for an
<br />informal conference on this permit renewal must be
<br />submitted to the Division of Reclamation, Mining and
<br />Safety, 1313 Sherman Street, Roam 215, Denver,
<br />Colorado 80203 within 10 days of the fast data of
<br />Publication of this notice.
