Negative Results Report <br />Cultural Resource Survey <br />Mountain Coal's Sunset Trail Lease Modifications Permit Revision #PR -15 <br />Gunnison County, Colorado <br />Abstract <br />Mountain Coal Company, LLC (Mountain Coal) contracted ERO Resources Corporation (ERO) to conduct <br />a cultural resource survey for their permit revision to lease modifications. ERO, in cooperation with <br />Mountain Coal, defined the area of potential effect (APE) as a 1,327.16 -acre block to accommodate <br />design modifications for proposed mine ventilation boreholes and access roads and future work. <br />Mountain Coal proposes construction of 6.9 miles of temporary roads and 38 mine ventilation borehole <br />locations. ERO conducted Class II survey of 951 acres (72 percent) of the APE. The additional 376.16 <br />acres (28 percent) were excluded for slope. Because Mountain Coal's work requires a federal permit, <br />the cultural resource survey was conducted in compliance with Section 106 (54 United States Code <br />(U.S.C.) §306108) of the National Historic Preservation Act (54 U.S.C. §300101 et seq.) (NHPA, 1966, as <br />amended). <br />No previously documented or newly recorded cultural resources are within or overlap the APE. The APE <br />was negative for cultural resources and ERO recommends a determination of "no historic properties <br />affected" pursuant to 36 Code of Federal Regulations 800.4 of the NHPA. <br />ERO Project #10145 I <br />
