shall have the right to erect a plant or plants on the leased property to process materials <br /> including, but not limited to, crushing spreads, wash plants,asphalt plants and ready <br /> mix plants and may erect such temporary buildings and install such machinery and <br /> equipment as may be useful in connection with its operations_ In the event Lessee <br /> requires any utilities for its operation it snail be solely responsible for obtaining the <br /> utilities for its operation it shall be solely responsible for obtaining the utilities,paying <br /> for all capital fees associated therewith and paying for the cost of utility service. Lessor <br /> shall grant such easements as are reasonably necessary for the installation and <br /> maintenance of lines providing utility service. Lessee shall be responsible for any EPA <br /> and/or reclamation requirements,and shall hold the Lessor harmless from any liability <br /> for its failure to comply with the SPA and/or reclamation requirements. <br /> 13.Removal of Improvements and Equipment. Lessee shall retain full ownership of all <br /> equipment and improvements placed on the property except for fences,gates and <br /> cattle guards which shall be the property of Lessor. Lessee shall have the right to <br /> remove all equipment and improvements prior to the expiration of the Lease or within <br /> reasonable time thereafter. Lessee shall retain the right to remove all such equipment <br /> and improvements after termination of this Lease for any cause. <br /> 14. Sublettir)g. Lessee shall not have the right to sublet any or all of Lessee's rights under <br /> this Lease without Lessor's consent which shall not be unreasonably withheld provided, <br /> however. Lessee shall not be relieved of any obligations herunder by any such sublease <br /> unless 6_essar consents to the-release of obligations in writing, <br /> 15. Miscellaneous Provisions. <br /> 1. Bindina Effect. It is expressly understood and agreed that all the covenants <br /> and agreements-contained in this Lease shall extend-to and be binding-upon <br /> the successors, heirs,executors, legal representatives,and assigns of the <br /> respective parties herto. <br /> 2. No Partnership or Joint Venture. Nothing contained in this Lease shall <br /> constitute or be construed to be a partnership or joint venture between <br /> Lessor and Lessee. <br /> 3. Amendment. This Lease cannot be changed or modified except by a written <br /> agreement signed by both parties. <br /> 4 <br />
